Representative Eric Swalwell (D-CA) declared Tuesday on MSNBC’s “The Last Word” that former President Donald Trump “is going into a season of legal reckoning.”
Anchor Lawrence O’Donnell said, “The evidence since your case was filed has developed very much in your favor. Including much of what we heard in the January 6 committee from people who actually attack the Capital, saying on video that Donald Trump sent them there to do that. That is your essence of your lawsuit.”

Legislators are protected from libel and slander charges only so long as the remarks are made while in session in the halls of congress.
Libel and slander outside of congressional sessions are not protected.
President Trump should sue every one of the members of congress who have falsely accused him.

Legal BS, not lawful
This raises a real Constitutional crisis, and I’ll be anxious to hear from the legal commentators.
In a civil suit, you have the right to attend depositions, challenge discovery requests, and cross examine witnesses. The democrats are using the power of Congress to conduct discovery for the civil suit Swalwell brought, meaning the defendant in that suit has no ability to challenge discovery requests, or even cross-examine. The Constitution says you have the right to face your accusers, so much for that little right. Trump should file a motion to exclude everything resulting from the committee on the grounds of fruit from a poisoned tree.
