Alec Baldwin film-set shooting an accident, medical investigator rules

The fatal film-set shooting of a cinematographer by actor Alec Baldwin last year was an accident, according to a determination made by New Mexico’s Office of the Medical Investigator following the completion of an autopsy and a review of law enforcement reports.

The medical investigator’s report was made public Monday by the Santa Fe County Sheriff’s Office along with numerous reports from the FBI on the revolver and ammunition that were collected following the shooting.

Prosecutors have not yet decided if any charges will be filed in the case, saying they would review the latest reports and were awaiting cell phone data from Baldwin‘s attorneys.

Baldwin was pointing a gun at cinematographer Halyna Hutchins when it went off on Oct. 21, killing Hutchins and wounding the director, Joel Souza. They had been inside a small church during setup for filming a scene.

While it’s too early to say how much weight the medical investigator’s report will carry with the district attorney’s office, Baldwin‘s legal team suggested it was further proof that the shooting was “a tragic accident” and that he should not face criminal charges.

“This is the third time the New Mexico authorities have found that Alec Baldwin had no authority or knowledge of the allegedly unsafe conditions on the set, that he was told by the person in charge of safety on the set that the gun was ‘cold,’ and believed the gun was safe,” attorney Luke Nikas said in a statement.

NOT the end but sure shows that special treatment is NOT equal treatment. I think the medical investigator report will be used as part of the defense of "It wasn't me that pulled the trigger!" of arec barwin, POS supreme. You or me? The conclusion and trial would have been over already for us mere peons.

An accidental shooting just makes it manslaughter or third degree.

That is still five years in prison under the laws of New Mexico. Not that I’m expecting a day in jail for this guy.

It’s an “accident” only because he didn’t “intend” to pull the trigger ... while he was pointing a gun at a human being.

No charges, IMO .... but this won’t help in the civil suit filed by the husband .... gun had to be fully cocked, trigger pulled to fire, gun in working order ... that’s a lot of “accidental”, plus he didn’t participate in safety training for ‘cross draw’. I hope the family of Alec’s victim wipe him out financially.

He pulled the trigger, and that was an inherently unsafe activity.

I do believe it was an accident out of stupidity, so it’s still at least manslaughter.

Alec needs to stop saying he didn’t pull the trigger. That is asinine.

I’d already be serving my sentence if I had shot someone in similar circumstances. There are at least two tiers in the “justice” system.

I will bet $1000 that he took the gun, gripping the single action revolver with the trigger fully pressed. He then pulled back the hammer expecting it to be cocked and let the hammer go. The hammer struck the primer and the cinematographer suffered a fatal wound.

Of course it was an accident. But it was also criminally negligent stupidity and carelessness.

Every deliberate step of the multiple steps necessary to get that bullet into those people was done.

That is a serious deadly shooting accident done in a deliberate manner, that requires serious sentences, not a celebrity, oh well, stuff happens, it’s Hollywood.

It is also considered an accident when someone runs a red light and kills another driver or pedestrian.

That doesn’t change the fact the accident resulted in the death of another human and the driver is liable.

I was thinking along similar lines.

Drunk driving and hitting someone is an accident as well. Deciding to drink then drive was a choice but so was pointing a weapon at people.
