The fatal flaw in our constitutional republic: The founding fathers did not design a system that could withstand what Democrats are now doing to it.

The constitution is just a piece of paper.

If the people don’t respect and abide by it, it doesn’t matter what’s in it.

There has to be enough people with enough power and determination to force (or convince) the vast majority to follow it.

Those that don’t want to follow it today are more numerous and determined than those who follow it.

Unless our side finds a way to impose it on those that don’t want it, it is pretty much dead.

It all goes back to... People get the government they deserve.

Yes they did… it involves the second amendment and a spirit of rebellion. Tree of liberty … refresh. We don’t like it, but they did give us a mechanism.

“but the SC thinks they have discretion in choosing not to hear the case”

Yes, that’s a problem. They of course DO have discretion in cases outside their original jurisdiction. They don’t have to accept an appeal of a state supreme court or federal district court decision. But they really don’t have a choice to accept a case in the Supreme Court’s original jurisdiction (without cause), since that results in no legal recourse for the litigants and is a violation of the due process clause of the 5th amendment.

The founding fathers provided the guidelines, the democrats are coloring outside the lines. The GOP haven’t been fulfilling their roles.

Yep, they left us that ultimate recourse but everyone is still at the point where they are desperately hoping we won’t have to resort to it.

Basically we’re in the 1850s now.

We can no longer whistle past the graveyard ... that was 2020, now in 2022, we are walking in the graveyard ... after 2024, we will be a marker in the graveyard.

I read the whole thing and nowhere did I find his recommendation that he would have made to the founders to fix the problem he describes.

Just another long but empty “see how smart I am” piece.

Capture one or both of the political parties in the United States.

— Communist goal #15

Franklin Roosevelt’s rapid conversion from Constitutionalism to the doctrine of unlimited government is an oft-told story. But I am here concerned not so much by the abandonment of states’ rights by the national Democratic Party — an event that occurred some years ago when that party was captured by the socialist ideologues in and about the labor movement — as by the unmistakable tendency of the Republican Party to adopt the same course. […] Thus, the cornerstone of the Republic, our chief bulwark against the encroachment (on) individual freedom by Big Government, is fast disappearing under the piling sands of absolutism.

The Republican Party, to be sure, gives lip service to states’ rights. We often talk about “returning to the states their rightful powers”; the (Eisenhower) Administration has even gone so far as to sponsor a federal-state conference on the problem. But deeds are what count, and I regret to say that in actual practice, the Republican Party, like the Democratic Party, summons the coercive power of the federal government whenever national leaders conclude that the states are not performing satisfactorily. …

The Conscience of a Conservative (1960), pp. 24-25
Right; let’s blame the Democrats alone and assign no equal blame to the RINOs.

“The Democrat Party: Power, By Any Mean Necessary”

I don’t think you erred on that. Nope, I think you said something that is eminently true!!!

The Dems will do any mean thing to get power and hold on to it.

“Power, By Any Mean Necessary”

Like it or not, that is the name of the game. You either play it, too, or you get run over.

There are no other choices. Only when the other side sees that you can be just as nasty as them do you start getting some compromises and a tenuous peaceful coexistence.

It’s the logic of assured mutual self destruction.

It’s not a flaw in the constitution. It is a basic element of self governance. God has the same problem with his creation. A bunch of a holes screwed it up.

I teach a class that helps legal immigrants prepare for their naturalization interviews. One question that is on the application for naturalization, and is asked during the interview is, “Do you support the Constitution of the United States”? Of course everyone says yes. I ask my students what that means. Outside of obeying the law, they really don’t know. I tell them that it means they will support the republican form of government that is established by the Constitution, and they will respect the rights and freedoms guaranteed by the Constitution to all citizens.

That kind of commitment is lacking among too many Americans, including many in public office, and that is the source of our problems. Every shady vote, every canceled voice, is evidence of that deficiency.
