MSNBC contributor Claire McCaskill said Tuesday on MSNBC’s “Morning Joe” that the discovery of classified documents at President Joe Biden’s home and office make it “very difficult” to hold former President Donald Trump criminally liable for the classified documents found at Mar-a-Lago.
Co-host Mika Brzezinski said, “When it comes to these documents, politically, they cancel each other out, which happened before with another candidate, which we can talk about. But at the same time, there are huge differences here. And the difference is that Donald Trump took the documents and refused to give them back.”
McCaskill said, “Those of us who understand that Donald Trump is a fraud and a liar are grasping tightly to those differences, and I get it. I get it that what Donald Trump did is totally different than what Joe Biden did. But as a prosecutor, I will tell you, we need to have a sober moment because when a jury is trying to figure out whether someone should be held criminally responsible, that’s going to be in their head. Let’s not kid ourselves here. The easiest case for the special counsel prosecutor to make against Donald Trump were the documents at Mar-a-Lago before this. Now it is no longer as easy. It is probably very difficult because the whataboutism is going to be rampant in that jury room. I think it’s important for us to recognize it may not be fair, it may not be right, but that’s the reality of where we are.”

Wasn’t McCaskill the exploiter of elderly people who got an extra six years warming a U.S. Senate seat from Missouri because her opponent said something really stupid during her reelection campaign?
Biden has the docs in his office and garage that are accessible to almost anyone, and it's only “embarrassing”.
Makes you wonder what is really going on out there?

The democrats are going to throw Biden under the bus and then try to use the same argument against Trump. It’s a twofer.
Its an admission that “Trump Secret Documents” was PURELY for political show.
If Trump is guilty, then Biden is more guilty.
If the DOJ/Deep State is so concerned about “the law” - then prosecute them both.
An honest person would say, “The law is the law.”

SORRY CLAIRE! Biden had ZERO authority to have those documents in his possession whereas President Trump had ALL authority to DECLASSIFY ALL of the documents in his possession! The only reason Claire wants this to go away is because BIDEN BROKE THE LAW and President Trump did not! Keep grasping at straws Claire.

Under the legal system these are two unrelated cases and each has no bearing on the other, and also the law is different for a vice-president than for a president.
Those that still want to indict PDJT. It’s time to sacrifice Joe for the same thing (although worse) so they can (try to) do the same to PDJT. As what Biden did was worse, you have no basis to go after PDJT - this is their last hope of making sure he doesn’t run.
It is more than a straw for the dems and the MSM, of course, it is convenient reasoning.
Given Hillary's presidential popular majority vote, they will be able to convince a majority of voters the reasoning is appropriate.

The real problem with this case is the ‘why’. Why did Biden pay thousands of dollars an hour to have lawyers look for missing classified documents - rather than let the FBI look. They’re on his team after all... no sniffing doctor Jill’s underwear...
I’m guessing the librarian told Biden documents were missing - and that’s why Biden’s spent so much time and money trying to find them. “Missing” could be ‘traded’ as in traded to China and Ukraine. Sold. That’s where espionage comes into play... Of course the excuse will be they were accidentally put in a burn bag as leaving the Obama White House was rushed and ‘mistakes were made’... lies.
If Trump could be charged, he would have been.
Trump kept his copies in a secure place, Biden didn’t.

There is a duty to safeguard secret documents from people not officially trusted by the federal government to handle the documents.
Biden may need good lawyers, but they probably lacked proper security clearances. He has staffers with proper clearances.
Probably the only true thing she has spoken in the last decade.
Actually, it’s the law that makes prosecuting Trump difficult.
Trump, unlike Biden, was President at the time the GSA removed the documents and was communicating with both the National Archives and the FBI in an ongoing manner, with the documents held at Mar-a-Lago in a secured area, with Secret Service protection at ALL times.
Biden, the former VP, on the other hand had SCI documents, illegally removed from a SCIF with no chain of custody protocols, moved repeatedly and accessible to others.
Multiple felonies in Biden’s case, and what would normally be considered the Presidential Records Act in-process in Trump’s case.
The National Archives Act, (NARA) is not a a criminal statute, so they will have to find something else to charge Trump with, which is obviously their agenda.
Trump, as president can declassify ANYTHING. Biden as VP can ONLY declassify documents that he classified to begin with.
Biden’s case is clear cut felonies, regardless of intent.
