Do leftists really want to win this case?

Do they want a world where each time a media company reports something that isn’t true they should be forced to pay billions?

Dominion will LOSE their lawsuit. Fox News talent (Tucker Carlson particularly) and his management only directed malice towards President Trump while The Steal was unfolding. There was no malice from Fox News talent and management towards Dominion while The Steal was happening.

Thanks for posting - I am going to read it later. But upholding Freeper tradition, I’m not letting that stop me from commenting right away...

I hope Fox has asserted a fundamental point: Every “news” and “opinion” content provider can report that so and so claims X, without endorsing the view. So long as X really made the claim, the media outlet has told the truth, even if the reported allegations such as “Trump colluded with Russia” are total lies. X is liable if their claim was deliberately, knowingly false and intended to harm a plaintiff. It is not the media’s job to be omniscient.

If Dominion wins this suit, the “so and so said this” reporting that dominates the “news media” and internet will be severely constrained. That would violate the First Amendment, and terminate freedom of speech and the press. That’s a high price, but never again having to hear what Alyssa Milano said about something, is no small recompense.

Having drafted and argued numerous Motions for Summary Judgment, I can say this Motion is a loser. The basic rule is that if all the facts that the non moving are deemed true, does the non moving party have a tenable claim. Here, Fox is arguing numerous facts which is contrary to the basis for a summary judgment and is best saved for trial. In fact, the easiest way to defeat a MSJ, is to toss in disputed facts the support a legal claim.

Some law firm made a lot of money on this monstrosity of a motion.
