NY among 10 states set to sue EPA over standards for residential wood-burning stoves

Attorneys general from 10 states, including New York, plan to sue the U.S. Environmental Protection Agency, saying its failure to review and ensure emissions standards for residential wood-burning stoves has allowed the continued sale of appliances that could worsen pollution.

That means programs that encourage people to trade in older stoves and other wood-burning appliances, such as forced-air furnaces, haven’t necessarily improved air quality, the states say.

“If newer wood heaters do not meet cleaner standards, then programs to change out old wood heaters may provide little health benefits at significant public cost,” the states wrote Thursday in a 60-day notice of intent to sue.

The states involved are New York, Alaska, Illinois, Maryland, Massachusetts, Minnesota, New Jersey, Oregon, Vermont and Washington, as well as the Puget Sound Clean Air Agency.

They allege that the EPA’s current standards aren’t good enough and that even if they were, the agency’s testing and certification program is so ineffective that it has failed to ensure those standards.

The EPA declined to comment on pending litigation.

The states allege that the EPA’s current standards must be reviewed and that its testing and certification program is so ineffective, it has failed to ensure the existing standards.

The EPA’s Office of Inspector General, in a report released in February, found the EPA’s 2015 performance standards for residential wood heaters was flawed and said the agency has “approved methods that lack clarity and allow too much flexibility.”

“As a result, certification tests may not be accurate, do not reflect real-world conditions, and may result in some wood heaters being certified for sale that emit too much particulate-matter pollution,” the report said.

I guess charcoal BBQ grills, pellet stoves/smokers, propane grills and backpacking stoves will be next to be examined for banning.

I wonder how in rural Alaska or any truly rural deer camp one gets sufficient electricity to operate any form of heat pump so that there is limited pollution?

People buying new wood burning wood stoves are buying more efficient heat.

They produce more heat from less wood.

By definition they are cleaner.

These evil bustards simply do not want people burning anything. They want all of us plebes freezing in the dark.

Watch for them to strike a deal .... that brings in more regulation

I have a gas furnace but choose to heat with wood. I don’t intend to change my lifestyle - regardless of what the facists demand or dictate.

Does this mean I have to seal up my wood burning fireplace? What do we do when the power grid inevitably fails because all the EVs are plugged in? It gets really cold here in Winter!

Your correct.

We have one of those new fangled EPA wood burners that reburns the smoke. Our chimney practically never needs cleaning. The reburn can be watched from the window in the burner’s door and resembles flames coming from a gas stove.

The absolute worst way to heat with wood is a conventional fireplace, where most of the heat just sails right up the chimney.
