Maine Has Yellow Flag Law, Allows Temporary Confiscation of Guns

While gun controllers like Shannon Watts react to Wednesday’s shootings by pushing a red flag law for Maine, it should be noted that the state already has a yellow flag law.

A yellow flag law allows police to petition to have an individual’s guns removed.

On July 1, 2022, Maine Public Radio focused on the state’s yellow flag law, suggesting it “could be a model for gun control” and noting the law had been used 22 times to take away guns during the previous two years.

It all started in 1966 with Frederick Wiseman's documentary film, "Titicut Follies," a look into the Massachusetts Home for the Criminally Insane at Bridgeater. I saw the film on PBS years ago, and it's difficult to watch. The inmates were treated no better than animals. This gained the attention of mental health professionals who decided it was time to put an end to snake pits like that.

The idea was to close the asylums and create locally based facilities for the treatment of the mentally ill. Gov. Reagan and other governors closed many of the snake pits, but the locally based facilities were never funded. Only half the problem was solved.

When you buy a gun, you have to assert:

1) You are not crazy.
2) You are not on drugs.

I know that’s the case in my old state of Maryland. I had an uncle whose wife, an evil, nasty woman, swore out an order of protection against him. Under a 2009 state law, his guns were confiscated from him. Then she had her brother and another man shoot him dead in front of his bar after she made him a sitting duck.
