Rep. Eric Swalwell (D-Calif.) is expected to testify in a Colorado trial aiming to determine whether former President Trump is eligible to be on the state’s 2024 ballot under the 14th Amendment’s “insurrectionist ban.”
A lawyer for Citizens for Responsibility and Ethics in Washington (CREW), which brought the case, said Monday that Swalwell will explain “how the mob” that attacked the Capitol on Jan. 6, 2021, “disrupted the core constitutional process of a peaceful transfer of power.”

The anti democracy plaintiffs are bringing in an expert witness who will attempt to rebut the idea that Section 3 of the 14th Amendment does not apply to the President of the United States. This will be an interesting spin.
Section 3 of the 14th Amendment specifically omits listing the office of the President. It explicitly mentions Senators, Representatives and Electors of the President/Vice President but leaves out the President. Does this make any sense unless they were not considering that office to be subject to this section ??? The argument will be made that the President is covered under the next part of the section which states “any office UNDER the United States”. Supposedly the expert will argue that historically the Presidency is an office under the US. But I cannot find any case law or legislation promoting this view.
In 1878 (just 13 years after the 14th Amendment was written and passed) David McKnight published his widely referenced book “The Electoral System of the United States, 1878: A Critical and Historical Exposition of Its Fundamental Principles in the Constitution, and of the Acts and Proceedings of Congress Enforcing It”. In that work he states the the Presidency is obviously NOT an office under the United States. Being that he is writing at a time contemporaneous with the passage of the 14th Amendment, his view clearly must reflect the general thinking of the time. That is reinforced by the fact that his assertion was not challenged at that time or at any time until recently.
