Pleading the 5th amendment is not being cowed into submission. They would not be rolling over on anyone, it denies the Democrats of their testimony and complies with the subpoena at the same time.

Exactly!

Acting in contempt was almost certainly what they were hoping for; doing so filled out their hand.

One should make every attempt to pick the battlefield or at least deny the opponent the choice.

It was time for a tactical retreat in the form of a safe disengagement that thwarted their offensive - in this case pleading the 5th.

Bannon and Navarro IMO did exactly what the Democrats were hoping for, be defiant and refuse to comply with the subpoena.

IF they had shown up, pled the 5th and refused to answer the Democrat’s questions, they would deny them the information they wanted and complied with the subpoena at the same time.

I don’t see how anyone can say that’s caving or going along with a charade, it’s not IMO.

The entire 1/6 committee was a joke, but regardless of we think Congress has the legal authority to subpoena people to testify, by pleading the 5th you legally comply with the subpoena and assert your 5th amendments rights by giving the Democrats nothing.

In a Republic where the legal process was the rule of law and not a form of government persecution, that you have the right to plead the 5th Amendment is something that can be done to preserve your rights under the law in a courtroom, where the judge can instruct the jury on the context of the 5th Amendment, you would be right.

But we no longer live in that country.

We live in a country where the there is no longer the rule of law, (a Republic) but the rule of men, where the government, courts, and media work in concert to persecute dissidents or others they deem dangerous to their ideology, taking the 5th is akin to a guilty plea in the court of public opinion, and that is where the battle is being fought and won.

Well, you and I are certainly on the same page.

IMO, the "committee" Pelosi put together already had Navarro's work product in its possession and were likely primarily interested in discovering what governmental sources may have been helpful in that regard.

The stolen election was their successful coup and they know there is evidence of such in abundance. They are quite serious about finding and cleaning out as many Trump supporters as possible, to say nothing of ordinary patriots in key positions.

Of course, more generally, the committee was anxious to nail both Bannon and Navarro with perjury charges in order to dissuade future opposition.

Part of the subpoena was to produce documents, though. So appearing and pleading the 5th would not have complied with all of it.

You are raising a lot of good, historically relevant points in this thread and particularly in this post.

I will mention with regard to the above quote that the public knows full well where Bannon and Navarro stand on the election. IMO, any plea by them of the based on the 5th would have been roundly appreciated and applauded by the public.

Eric Holder was found in contempt but the Just Us department chose not to prosecute. What is good for the goose is not good for the gander apparently.

They’re out for Bannon’s and Navarro’s blood, and it would’ve been a hot mess even if they did show up at the hearings. The guys are too powerful in the MAGA movement to allow them to persist. It’s going to get uglier for them long before Election Day.

Re: 49 - Agreed. Invoking the 5th Amendment would have been appropriate. The Committee would then need to consider if they would offer criminal immunity, at which point testimony could be could be compelled under penalty of contempt.
