Trump is not immune from prosecution in his 2020 election interference case, US appeals court says

A federal appeals panel ruled Tuesday that Donald Trump can face trial on charges that he plotted to overturn the results of the 2020 election, rejecting the former president’s claims that he is immune from prosecution.

The decision marks the second time in as many months that judges have spurned Trump’s immunity arguments and held that he can be prosecuted for actions undertaken while in the White House and in the run-up to Jan. 6, 2021, when a mob of his supporters stormed the U.S. Capitol. But it also sets the stage for additional appeals from the Republican ex-president that could reach the U.S. Supreme Court. The trial was originally set for March, but it was postponed last week and the judge didn’t immediately set a new date.

The trial date carries enormous political ramifications, with the Republican primary front-runner hoping to delay it until after the November election. If Trump defeats President Joe Biden, he could presumably try to use his position as head of the executive branch to order a new attorney general to dismiss the federal cases or he potentially could seek a pardon for himself.

The appeals court took center stage in the immunity dispute after the Supreme Court last month said it was at least temporarily staying out of it, rejecting a request from special counsel Jack Smith to take up the matter quickly and issue a speedy ruling.

The legally untested question before the court was whether former presidents can be prosecuted after they leave office for actions taken in the White House related to their official duties.

The decision describes the types of immunity that the president has.

As President, Obama instituted a gun-running program, that ended with the death of Brian Terry, a Border Patrol Officer, and the majority of the weapons have never been found. Obama also used his intelligence agencies to spy on Congressional Republicans, journalists, and international leaders, yet somehow he has immunity for all the illegal $hit he did during his 8 years in office? This country is a third-world commie $hit hole.

These risks do not overcome “the public interest
in fair and accurate judicial proceedings,” which “is at its
height in the criminal setting.” Vance, 140 S. Ct. at 2424.

***********************************************************

Now, lol, from the jump, I will admit that my opinion doesn’t mean squat. That said, the above sentence, plucked out of their too long diatribe, clearly states WHERE and HOW wrong they are.

Simply put: YOU ARE DEAD WRONG! “YES, IT DOES OVERCOME!”

Regardless of who’s President, Democrat, Independent, Republican or RINO.....he/she CANNOT be constantly pilloried (second guessed, aggravated, hindered) by the threat of hundreds of biased low IQ lawyers (DA’s) across the country suing him personally. This specific fact trumps EVERYTHING else and that is why this DC ruling of no doubt Obama/Obiden/Clinton appointees, will get overturned.

It’s rather similar to cops. Now we see in Soro’s Run city’s the cops just not answering calls or responding to criminals right in front of them. Why take the risk? Presidents will claim the same thing! You can’t fit a square peg in a round hole. Again, this DC Appeals Circus will get overturned.

The dims have really lost their minds.

They are risking setting precedent for prosecuting ex-presidents for actions taken while in office.

Their grounds for prosecution are nothing more than the hallucinations of the mentally unbalanced.

But if they succeed, a precedent will have been set for all future ex-presidents.

That lays Biden, as well as the entire Biden family, present and past holders of top executive offices such as the CIA, FBI, DOJ, Homeland Security, etc., all vulnerable ....

Obama, George Bush.....

Because those who have held those offices have a paper trail already known to the public that is real and valid evidence.

If Trump is convicted, we will see dozens, maybe even hundreds of prosecutions.

If the dims were not dim, they would be very careful about the risk in damaging the immunity of presidents past and present.

If Trump is convicted, we will see no Democrats prosecuted for similar acts. Because it’s all political, and Dems own the DC courts.

There is finally a groundswell that will bring some changes in congress and possibly in the courts.
