What If Trump Is Sentenced to Prison and Wins the Election?
PJ Media ^ | 03/05/2024 | Rick Moran

Posted on 03/05/2024 9:42:57 AM PST by SeekAndFind

Donald Trump is facing 91 criminal charges after being indicted four times. Regardless of what his supporters think about those charges, the wheels of justice are turning and Donald Trump will likely be convicted on several felony charges.

When those convictions come will be critical to the question of whether Trump will take the oath of office from prison and whether he will govern from behind bars.

Since it is a generally accepted legal opinion that a president cannot be prosecuted while in office (although there would likely be challenges to that tradition), if Trump is sworn in without being convicted, it's difficult to see how he could be denied office. All prosecution would be on hold as long as Trump served as president.

But what if Trump is convicted of felonies before Election Day? Or Inauguration Day? There are no constitutional guardrails to guide the country through such an unprecedented scenario.

Trump would be free to appeal any conviction, of course. But there's nothing in the law to prevent vindictive, Trump-hating judges from putting him behind bars while the appeals move forward.

Reason.com's Keith Whittington has developed some scenarios of what might happen if Trump is in prison and wins the election.

If Trump is cooling his heels in the big house when Inauguration Day arrives, he could simply be sworn in as president in his prison cell. The presidential oath can be taken wherever the presidential designate happens to be at the time of his ascension to the office. Nothing says the president cannot be a convict, though the Department of Justice has insisted (when this was a live question under Nixon and Clinton) that a sitting president cannot be prosecuted. Joe Biden will stay out of prison—at least until he moves out .

Trump could be pardoned by Biden before he takes office. Admittedly, that’s a far-fetched scenario, but Biden is old-fashioned enough to put the country ahead of his own bitter feelings after a loss.

There’s also the possibility that Trump could take the oath of office and then pardon himself. The president’s power to pardon is nearly unlimited and there would be nothing to stop Trump from making the left’s heads go into orbit by issuing himself a pardon.

He’s immune.

If he’s not, we could find a 90% Republican county and indict Biden for failing to defend the border which is a violation of his oath of office and an insurrection act.

There is no way he is going to prison.

The Secret Service would have to be with him 24/7 and they would have to empty the prison of all the other inmates.

There’s also the possibility that Trump will inform the illegal aliens he brought here that it’s Biden’s fault they are all being deported. And here is where he lives.

THE AMERICAN PEOPLE are facing 91 criminal charges after being indicted four times by insurrectionist Democrats and the Left.

He’d run the country from a federal penitentiary.

A man has to do what he’s got to do.

Joe Biden has been a nasty, vindictive little bitch from before the beginning of his political career. Joe Biden was an architect of the "high tech lynching" of Supreme Court nominee Clarence Thomas. You really think that petty little turd Biden would pardon President-elect Trump?

Make a concession. Find a cell big enough for the Resolute Desk.

Which of These 6 Oval Office Desks Will Donald Trump Pick?

The warden would get a new office and the old one might get oval walls.

He’s facing state charges in Georgia, if that charade continues. The governor of Georgia is currently a Republican and could pardon him, of course. Presumably he could pardon himself if convicted on Federal Charges. And why not?

Biden is fool. If he convicts Trump there is absolutely nothing preventing Trump for indicting and trying Biden in Texas or Mississippi for manifold corruption charges, and make it stick.

There is a very big reason why Adam Schiff-face is running for Senate. He was handpicked to be the go-to guy to lead the removal because if DJT is convicted it will be four years of non-stop impeachment hearings

His appeals move past his inauguration date, at which point he pardons himself.

Georgia is the only State case, where he would lack that power, but that case will fall apart before Election Day.

COLLECTING RENT IN JAIL
Don’t worry; you can still collect rent while in Jail. You can even buy and sell properties and buildings while in Jail.

In fact, due to this, later on in the game of Monopoly, one strategic strategy would be to go to Jail on purpose to avoid risking landing on other players’ properties. But keep in mind that you can only stay a maximum of three turns!

Only for Federal charges.

If Trump is convinced by NY or GA, he can't pardon himself and will not be able to serve his term until released.

What If Trump Is Sentenced to Prison and Wins the Election?

The scenario of Trump going to prison has become much less likely.

Not sure why this question is being asked now.

Georgia is falling apart.

Not sure about New York.

Why aren’t we indicting Obama and Biden?

Obama killed an American citizen in a drone strike with no trial or conviction. Charge him with murder if he doesn’t have immunity.
