Bryan James Epis, the first person associated with a California medical marijuana dispensary to be tried in federal court for growing pot, was sentenced Monday in Sacramento to a mandatory 10 years in prison.
Epis, 35, insists the crop in his Chico house was only for himself and four other seriously ill people whose physicians had recommended the drug in conformance with California's 1996 Compassionate Use Act. But he ran head-on into federal law that makes no allowance for medical necessity.

Is TEN YEARS MANDATORY really appropriate? The earliest he can be released is after 8 and a half years on good behavior. BASICALLY FOR GARDENING!
What about the constitutional issues? What about states rights?
I think it's an outrageous miscariage of justice.

Epis has electrical engineering and law degrees and no prior criminal record. Well I'm sure glad we get to pay hundreds of thousands of dollars to imprison this obvious menace to society.

Under what phrase of the United States Constitution does the feds think they get the power to ban substances?

That would be the commerce clause, which according to drug warriors (and their friend FDR) gives the government unlimited power, since any activity you name can be claimed to have some vague relationship to interstate commerce.

In this instance it clearly does not. They are talking about growing and distributing the plant within California.
Constitutionally speaking I think this is a clear violation of state's rights.

What is it, like $150K a year to house a federal prisoner? Add to that the taxes this guy won't pay. We're taling over a million bucks. How about you volunteer to pay the whole thing if you are so anxious to rid the world of this "evil menace" to society?

Where is the mandatory sentence for battery? Or mugging? Or car theft?
10 years for vegitation. Absurd!
