Store Owner Opens Fire On Robbery Suspects (Both Hit!)

A store owner in Orange County, Fla., shot and injured two teens fleeing his store after they had allegedly robbed him at gunpoint, police told Local 6 News.

Police said Floyd Harvell, 17, and Keenan Felton, 19, went into Sam's Discount Food Store in Orange County at about noon and demanded money.

One of the teens distracted store owner Sung Kim and the other went behind him and put a gun to the store owner's head, police said.

As the men turned to leave, Kim pulled out a shotgun and opened fire on them, Local 6 reporter Erik von Ancken said.

Both were hit by gunfire, according to the report.

Kim will not likely face charges in connection with the incident.

"They recently passed a new law but an investigation will still have to ensue to determine what happened in this and take it from there," Orange County sheriff's spokeswoman Barbara Miller said. "But, normally, if the state attorney's office felt the store owner acted appropriately, then no (charges)."

Both of the teens were treated and transported to jail.

They face armed robbery, grand theft and aggravated assault with a firearm charges.

I wonder what his load was, buckshot, bird shot or rock salt? Rock salt is not life threatening but produces some very satisfying results and some remarkable scars.

If I was working at a convenience store I wouldn't load my shotgun with rock salt.

Mr Kim, you are a HERO!

He is my hero too. I worked at a convenience store when I was younger. I never had anyone pull a gun on me. But it did happen to a few people I know. I think anyone that holds up a convenience store or restaurant deserves the death penalty, no matter if anyone died or not.

Best of my understanding, the Florida law states you do not have to retreat to defend yourself. If you shoot a fleeing felon, you're on shaky ground. With the teens fleeing, how can you claim that you were defending yourself?

What looks "right" and what is "legal" are two different things. Using deadly force can result in a civil lawsuit even when you're in the clear with the criminal justice system.

It wouldn't be likely to get a good spread with buckshot at close range (register, to the door). I'd bet on bird-shot, given the fact that both were hit, and they didn't seem to be injured that badly.

Anyone have an update?

Yeah, Kim should have waited until they turned at the door and shot him first. Forget the fact that they had already initiated the act with a threat of death.

Too many issues of "Combat Handguns" have colored my views of the law. Survival can be at odds with avoidance of civil lawsuits for wrongful death.

Tell them they were facing you when you decided to shoot, but then they turned, and it was too late to hold back. Yes, it might be a lie in some cases.
