California Supreme Court blocks proposal to split state in 3 from November ballot

The California Supreme Court on Wednesday blocked a proposal that would split the state into three from the November ballot.

The court wrote that it took the step “because significant questions have been raised regarding the proposition’s validity and because we conclude that the potential harm in permitting the measure to remain on the ballot outweighs the potential harm in delaying the proposition to a future election.”

Last week, an environmental group sued to have the measure removed from the ballot. To substantially alter the state's governance under the California constitution, the group argued, a constitutional convention would need to be called -- and that requires a supermajority of both houses of the state's legislature.

Northern California in this plan would be anchored by the entire Snan Francisco Bay Area. Not normally viewed as a bastion of conservativism.

I wonder how the court defines “potential harm”

Maybe like what Paula Poundstone said when she got pulled over for ‘attempted speeding.’

It was a stupid pro-Democratic idea that would have increased California’s Democratic presence in the Senate. Good that it died.

As I’m reading the plan it would create two solid blue states plus one purple state with a giant and growing Hispanic population. So at best a wash on Senate seats. But it’s possible we lose 4.

I would be all for splitting California into two states. Carve out all of the counties that voted for Trump and make it a new state. The two new Republican Senators would cancel out the two old Democrats.

I’m happy with this. While the measure would have required the consent of Congress (which no same Republican Congress would have given), the democrats would have gerrymandered three states with perpetual democrat majorities. That’s four more permanent democrat Senate seats and four more permanent democrat Electoral College votes.

What do they teach judges in law school? How to pull sh*t out of your a$$?

How long can this go on? California has no laws except what the judges pull out of their butts. Since when are they allowed to let their "feelings" interfere with a legitimate political process?

That’s exactly what the Rats did with these three proposals.

The northern state includes leftist Frisco, the southern state is established Dem and the middle would probably end up Dem.

Nothing good would happen if it passed in my view.

By these arguments it would appear that West Virginia is an illegitimate state.

I am completely in agreement with you. This is judicial tyranny. The state constitution says the people are sovereign and for good or ill (often ill!) they reserved the right through initiate and referendum to exercise legislative authority. I agree that the proposed split was all wrong, but I was going to vote for it anyway just as a matter of principal because the split would never actually
Be enacted anyway.

That’s a special case from what I remember. The Virginia legislature was considered to be in a state of rebellion. And then the Congress approved the new state.

If it becomes three states each one will get to have 2/3 of a Senator.
