The ShopRite worker arrested for allegedly hitting Rudy Giuliani on the back inside a Staten Island supermarket walked free from court Monday after his charges were downgraded.
Daniel Gill, 39, who was still dressed in his ShopRite uniform following his Sunday arrest, kept his head down and refused to answer questions as he left Staten Island Criminal Court after his arraignment Monday.
His charges were downgraded to third-degree assault, third-degree menacing, and second-degree harassment over the caught-on-camera attack inside the supermarket.
Gill, who had no priors, was initially charged with second-degree assault involving a person over age 65.
Judge Gerianne Abriano refused the Staten Island DA’s Office’s request for supervised release and instead let Gill go on his own recognizance.

After not watching TV at all for decades, the death of my dear wife has caused me to binge watch Chicago PD, Law and Order, NCIS and others.
I have to remind myself “it’s only fiction by a screenplay writer” when I see the MANY smiling, smirking, laughing, grinning arrogant guilty perps walk out of court free.
But TV news shows the real ones smiling, smirking.......
I saw the video and all he did was pat Rudy on the back. We can’t get as stupid as the libs here.
Don’t be surprised if the next time he uses a knife, an axe, or a gun. New York City never meets a criminal they don’t reward for their bad behavior.
Looks like a real piece of work.
Whether he patted him, or he slapped him, his unwanted, and unprovoked, verbal abuse, and physical contact with anyone, Rudy or otherwise was anything but normal. He deliberately approached someone he doesn't know, and accosted Rudy while he was in a conversation with another person. Stop giving these pieces of $hit excuses, because next time, it could be far worse. They gave this guy a pass. And then they wonder why crime in rampant in NY City. Believe me, if it had been a Democrat instead of Rudy, the guy would have had the book thrown at him.

So, because of your comment here, I just watched it myself. The speed of the arm swing shows it was not just a pat on the back. I am not yet seventy and I can't imagine how I would feel if it happened to me in another ten years.
This tactic may have seemed mild, but a pat on the back is an easy way to inject a poison, or cause a sharp pain with a needle.
