Michigan residents could be charged with a felony, face up to five years in prison and get a $10,000 fine for using the wrong pronouns under 'unconstitutional' new bill

Michigan's House of Representatives has passed a hate speech bill, known as HB 4474, which criminalizes causing someone to feel threatened by words, including the misusing of their pronouns, with the possibility of a hefty fine or even jail time.

The bill introduces hate crime penalties for causing someone to 'feel terrorized, frightened, or threatened,' with 'sexual orientation' and 'gender identity or expression' included as protected classes.

Offenders could face up to five years in prison for such a felony offense or a $10,000 fine.

It is part of a continues effort by Democrats in the state to advance a pro-LGBTQ+ agenda in their first months in power.

The proposed legislation aims to replace the existing Ethnic Intimidation Act and extends protection against intimidation.

Critics argue that the bill poses a threat to First Amendment rights and lacks clarity in defining 'harassment', leaving it open to subjective interpretation.

The bill reads as follows: 'Intimidate' means a willful course of conduct involving repeated or continuing harassment of another individual that would cause a reasonable individual to feel terrorized, frightened, or threatened, and that actually causes the victim to feel terrorized, frightened, or threatened.'

If passed, penalties would be based on how the supposed victim and court 'feel' about a particular matter.

What constitutes as being deemed 'intimidation and harassment' would be up to the interpretation of the listener and a local prosecutor.

Critics argue that the legislation could infringe on free speech rights and undermine the principles of due process.

Michigan Democrats have made it a priority to further protect LGBTQ+ people since they took control of all levels of state government this year.

In March, lawmakers codified LGBTQ+ protections into the state's civil rights law, permanently outlawing discrimination on the basis of sexual orientation or gender identity in the state.

I don’t believe so...breaks my heart but it is true. They and rino Republicans have killed it. There are no laws or rights that are safe, there is horrific persecution on very large scale. No, America was killed but I do believe and hope we can resuscitate her.

Yep- the left are engaged in a very hostile takeover of our country- they get to break laws with Impunity while our side is held to very strict rules and laws, and often get falsely accused and convicted.

We have a constitution. It keeps getting challenged. But the challengers generally lose.

It is a drag to have to keep defending our rights but I guess that is the way it is going to be. Eternal vigilance is the price of liberty.

They’re basically in Illinois’ situation right now. It used to be only the big city was dominated by the Democrat machine, in Detroit, or Chicago, and the “downstate” areas were Republican and could offset it to at least make the legislature and governorship competitive between the two parties. But by now the big city Dems have bought off enough suburban politicians to negate any chance for the Republicans to take control of the state ever again. Half the population may still be Republican, but if just a few “red” counties are willing to play ball with the Dems, then it doesn’t matter.

Hysterics. Michigan is 6th Circuit. The 6th has already ruled on this.

"In a victory for free speech, the rule of law, and common sense, a three-judge panel of the U.S. Court of Appeals for the 6th Circuit recently ruled that a philosophy professor at Shawnee State University in Portsmouth, Ohio, could not be forced to use a transgender student’s “preferred pronouns,” and that his suit against the university for violation of his First and 14th Amendment rights could proceed."

The state case would be removed to Federal immediately, in this instance Western District or Eastern District for Michigan. Let's say worst-case scenario Eastern, the state is still going to lose on appeal to the 6th. The 6th will not only remand and reverse, but also block the legislation.

Will Michiganders soon be seeing posters of Whitmer labeled “Big Gretch Is Watching You.” Sadly the Peoples Republic of Minnesota is considering similar legislation. Can thought crimes be next.

This legislation has shorter life expectancy than an Army Medic in the sands of Iwo Jima.

There’s so much prior precedent, if it survives to the Supreme Court they’ll make mincemeat out of it if they grant certiorari. More likely they’d remand it back to a lower Court with a note to the effect of “Use you f’n brains this time!”
