Why Can’t Squatters Like Brett Flores Get Evicted, and How Did it Get to This Point

A former live-in Queens handyman has refused to leave the $2 million home where he once worked for several years, leaving the rightful property owners out in the cold — and it’s totally legal.

In Georgia, a property owner who left to care for his sick wife returned to learn that interlopers had moved in and changed the locks on his home, and he’s not allowed to kick them out.

The reason is a curious legal loophole that gives would-be trespassers the right to stay put if they only stay in a property long enough to claim legal residency — otherwise known as “squatter’s rights.”

This is good to know. As more and more people age and the cost of eldercare gets higher, many older folks might hire live-in help.

When the elderly person dies, the live-in help might try to establish squatters rights that the children will have to fight.

in the old days you only had to “know a guy” to have a squatter removed.

My niece lives in a small Co mining town - and get a very nice 3 bedroom home at the impossible rent of $300/month.

Why? The owner is scared spitless and empty home would quickly fill with squatters.

Better to get low rent and no meth-heads squatting than take your chances on an empty place.....

Not that I personally know a guy, but I would not be surprised to learn that the ol’ ‘know-a-guy-technique” can still be quite effective at pesky squatter removal.

I’m pretty certain the local taxing authority would glady foreclose and seize for back taxes while authorities do nothing to restore access to legal owner.

First thing I’d do, as the homeowner/taxpayer, is call an exterminator, have the house tented and fumigated.
Then have the locksmith there the first day after.

It amazes me people allow this to happen. In many states the owner is still allowed to stay in the home even though the squatter is there. Id invite my whole family and we would be extremely loud, eat all the food, work on the car in all hours of the night. Id give free gun cleaning workshops everyday.

I was shocked a couple weeks ago when the topic came up and one of my 16-year old sons defended the squatters. He is apparently being taught anti-capitalism in school. Private property is bad, if owner is not living there, it is okay for others to move in since there is a need, etc. UNBELIEVABLE.

Me? Have movers on standby, as soon as they leave the house, empty it, change the locks, sit at the front steps armed. If I thought it would not land OK me in jail, I would escort them out at gunpoint.

florida just fixed this issue statewide with a simple new piece of legislation that empowers LEOs to remove as trespassers those who claim residency unless they have a written document that proves residency or ownership, a written document such as a lease, bill of sale, title, etc. ...

I know the refusal to evict squatters made it legal under the law.

There should not ever be anything even closely resembling “squatter’s rights”.

It’s theft, plain and simple.

The person who bought it, owns it, and it’s his or her prerogative on how that property is to be used.

NOBODY should be able to just come in and take it over and then be rewarded for the theft by being given ownership of it.

Pull the electric meter late at night.

Leave some junk wire nearby at the pole where the drop originates.

The power company will probably refuse to reconnect.
