President Joe Biden’s “poor memory” was a key factor in not charging him, Special Counsel Robert Hur told Congress Tuesday.
Hur, who described Biden in his report as “an elderly man with a poor memory,” told the House Judiciary Committee that he could not charge the president with “willfully” retaining classified documents due to the president’s lack of mental cognition and the impact that would have on a jury. “I understood that my explanation about this case had to include rigorous, detailed, and thorough analysis. In other words, I needed to show my work,” Hur said. “I knew that for my decision to be credible, I could not simply announce that I recommended no criminal charges and leave it at that. I needed to explain why.”

Hur had a slam dunk case. Biden’s state of confused mind and how he would be perceived by a sympathetic jury on the stand were irrelevant. He should have been prosecuted. The only elements of the crime are knowledge he had classified documents and willfully removing them from the SCIF and not returning them. Hur had Biden’s admissions to these elements during the interview. These admissions were admissible to establish the elements of the case at trial even if Biden was no longer lucid when tried. If this were a Democrat special prosecutor and the subject of the investigation was Trump, there is no way he would not have been prosecuted. Had Hur prosecuted Biden, it would have politically offset the Trump Florida documents lawfare case.
Poor memory? He is just a liar and always has been. Hard to remember all the lies.

Quite right. The Trump case was solely an attempt to offset Biden's exposure which the Biden admin knew was going to erupt. When the Biden case could no longer be suppressed, Hur had to dismiss it with this absurd rationale.
Senior citizens should see whether they get a "total walk" with this defense to any criminal charges they face.

Another whopper for the history books. What a warped, selective, and criminal legal system this Republic is currently being ruled by. Communists and democrats have no shame acting the fool when it suits their purpose. If anybody wants to see this jackass reveal his true self, just look at a replay of his attack on Clarence Thomas at the hearings for the Supreme Court Justice. Thomas was an applicant for a position in govt and Biden was a low rated lawyer govt employee of the people. Biden was vicious and menacing and out of control in his screaming and other theatrics right up in the face of Thomas who could not answer. Biden and his communist democrat party buddies should all be in jail or mental institutions. This Republic deserves better and Trump is our one and only leader with the ability to get us back on track.
