BUCKHANNON, W.Va. (WBOY) — One man is in critical condition and facing criminal charges after the second shooting that happened in Upshur County on Wednesday.
Austin Arbogast, 24, of Buckhannon went to a home on Bailey Ridge Road in Buckhannon on Wednesday, March 20 “to forcibly take” a five-month-old child, according to a press release from the Upshur County Sheriff’s Office.
Arbogast was reportedly saying that “he was coming to the residence to cause bodily harm to [the victim’s] family, and kill the entire family,” the release said.
Deputies said a shoe print on the outside of the front door, which matched Arbogast’s shoes, showed he attempted to kick in the front door.
The victim, “fearing for the safety of his family,” fired a 9mm handgun from inside the house, which struck Arbogast, the complaint said. When the victim stepped outside onto the front porch, Arbogast “presented a 9mm handgun and shot [the victim]” wounding him; deputies said the round went through several layers of the home’s drywall, endangering those inside, including the five-month-old Arbogast said he was there to take.
The victim then fired more rounds at Arbogast, striking him more times and causing him to retreat, the complaint said. Arbogast “put down his firearm and laid by the front porch, and continued to state that after he recovered, he would kill [the victim],” according to the complaint.
Arbogast is hospitalized in critical condition, and the incident is still under investigation, according to the Upshur County Sheriff’s Office.
At this time, since Arbogast is not in the West Virginia Department of Corrections and Rehabilitation, a mugshot is not available.
I guess it would be illegal to finish the assailant off, after he stated that following his recovery he will return and kill the family.
The victim of this home invasion needs some range time.

“Several layers”? That means at least two walls. Might diminish your chances of hitting the target, no?
Isn’t an invader intent on harm, murder, and kidnapping more of a danger? What a stupid remark by the deputies.
I think the most probable interpretation is that Mr. Arbogast is either the father of the 5-month-old child or believes he is the father.

Sounds like over-penetration. I wonder what kind of ammo he was using.
and a bigger gun ... larger caliber .45 or 12 gauge would have done the job right ;)
His mistake is going there with a gun and threatening to kill others.
What a surprise. I wonder if the household he assaulted was the baby’s mother and her new sex partner. Irresponsible (chronological) adults produce terrible outcomes for children.

Sounds like a good reason to “accidentally” fire a kill shot, like putting down a mad dog.
I am reminded of the movie CUJO. The audience is yelling “SHOOT HIM AGAIN!” but the cop does not and......
