Two military members denied promotions for having HIV just won their lawsuit

An Air Force cadet and a Navy midshipman have won their lawsuit after being denied promotions for being HIV-positive.

Former Navy midshipman Kevin Deese and former Air Force cadet John Doe (a pseudonym) filed the lawsuit against the Department of Defense in 2018 when they were denied commissions after graduating from their respective service academies simply because they are living with HIV.

The settlement, announced Monday, will see that the two are commissioned as officers "in recognition of the status and military careers they qualified for and earned years ago," according to a Lambda Legal press release.

biden “settling” these suits is just a back door way of handing out reparations to his favorite groups without congressional authorization.

But Trump can do the same. As soon as he takes office everyone arrested for J6 can sue, and they don’t even have to win. Trump can just direct the justice department to “settle” for billions.

This was during don’t ask don’t tell timeframe? There would be no admissible evidence of being homosexual. Cast totals not from gay sex are not unknown.

Life expectancy of HIV infection is about 53 years now, for 20 year olds with proper treatment (meaning age 73) — though it is common but not yet confirmed that if the CD4 count rises to normal with treatment, it may stay that way without further treatment. The only reason this is not declared “cure” is because multi decade data is not yet in, given the retroviral treatments that achieved this started less than 30 years ago.

There is a 5-10 year offset from never HIV+ to HIV+ and treated. This could be the result of early averaging.

In a general way, HIV+ people live normal lifespans, and with treatment, further testing of them usually yields HIV- results.

Being denied commissions isn’t the same as being denied a promotion.

HIV is largely suppressible now, not curable - but it requires continuous medication.

Last I heard, they were up to four who are cured, with two more possible.

People who need care like that don’t belong in the military and the other military doesn’t need to risk exposure to their HIV.

In 2014, I read an HIV magazine article that said HIV infection causes the infected to age prematurely by 14 years. This happens even when treated with PrEP. HIV tainted blood will spread this aging. So, yes, HIV is a medical threat, unless one wants to die early. To see articles, check FR keyword hivacceleratedaging.

I am surprised. Of course you ignored my central point, and I don't know why, but I appreciate the fact that you stayed reasonable in light of the response you received. Too many cannot do that.

Uh, no, it isn't.

Your "undetectable status" is only as current as your last checkup yesterday. It isn't a durable, static condition. It can change in months, or even weeks.

HIV infection, even when treated early, still creates an underlying, chronic inflammation which affects body systems and makes them more vulnerable to failure much earlier than healthy, uninfected people. So, no. Uninfected people and HIV-positive people under "effective" treatment are NOT the same healthwise.
