So when will we be congratulating Justice Sotomayor on her confirmation?

There is a better chance of monkeys flying than the Republicans standing up to this nomination.

If a majority of United States Supreme Court Justices chooses not to uphold the U.S. Constitution, what are our options, if any?

"Maybe the Republicans can sit back and watch this one flame-out on its own."

There's a (far) better chance of the Senate confirming her without a single dissenting Republican vote. In fact, bet the hacienda on it.

Definately, and basically on the basis that they are afraid to stand up to a latina woman. The left is winning that battle of identity politics unfortunately.

But it was somehow ok for liberal Democrats to vote against Clarence Thomas without being considered racist.

I never understand the rules. It was ok for liberals to oppose Clarence Thomas because........because of Anita Hill........because he’s conservative??????? But it wasn’t racist to oppose him.

So if Sotomayor is liberal, then it’s racist and bigoted to oppose her?

Now you see how this works. And Republicans will trip all over themselves to help reinforce this template by walking gingerly and openly expressing concern that they don’t want to appear racist, rather than utterly dismissing and knocking that false premise completely down to the ground.

I’m not going to argue The Wizard of Oz with someone that goes by Kansas58.

"If a majority of United States Supreme Court Justices chooses not to uphold the U.S. Constitution, what are our options, if any?"

In the words of Pres. Andrew Jackson in response to the Supreme Court's decision in Worcester V. Georgia:
"John Marshall has made his decision; now let him enforce it."
IMHO should the unthinkable actually come to pass, then let them try to enforce it. At that point, the Black Robes will be irrelevant.

Just a little bit of humor. Where’s the criticism of Sotomayor?

Now if the Republicans can find some dirt on her...it can’t be something ridiculous (like having a Guatemalan nanny working illegally)—needs to be something better. Because opposing her on ideological grounds alone isn’t going to hold water with a lot of folks. I know that the Dems have done it time and time again. Forget Clarence Thomas and the Anita Hill debacle-—remember Bork. They opposed that man on purely ideological grounds—there wasn’t any alleged dirt on him.
