It appears that a judge Nakazato is attempting to steal this case from the original judge Carter without even following the procedural filings to do so. Typically motions have to be filed to inform the plaintiffs that a new judge is being assigned. Then the parties have to repspond etc. Apprently the new judge appeared out of thin air and said:" OK. I'm the new judge."

Did I interpret this correctly? Where did the old judge go? what happened?

Are you saying Nakazato is a magistrate judge in this case and that it is an option rather than have a Federal judge? What is the advantage of a magistrate judge?

I believe that this is a regular part of the lawsuit process and Orly Taitz should be familiar with it. It is done commonly and happened to me in US District Court in San Francisco. After a judge is assigned, but before a trial, both parties are called before a magistrate judge. It is sort of a last attempt to see if the suit can be settled without going to trial. In my case we met in his chambers and agreed to settle.

Orly says that Google placed the warning there on behalf of Soros’s son who sits on the board of directors of Google.


I’ve seen this quote before on FR and asked if anyone knows what the son’s name is. There is no Soros listed on the BOD of Google. I get the feeling Orly is making things up.

i actually found the motion. while she makes it sound like the new judge popped out of thin air and she states the new judge is disregarding the intent of Carter,i still don’t see how the new judge became involved. more tellingly,i don’t see any sign of Judge Carter protesting an usurpation of his authority.

Orly is once again showing that she doesn't have the faintest clue about litigating in federal court. Every federal case is assigned, immediately on filing, to both a District Judge and a Magistrate Judge. If you look at any document in this case, it will have on it the case number, which is SACV09-00082-DOC (Anx). The "DOC" means the case is assigned to District Judge David O. Carter, and the "Anx" means it was assigned to Magistrate Judge Arthur Nakazato ("x" being the code for "magistrate").

Under the Federal Rules of Civil Procedure, which Orly has apparently never read, District Judges decide "dispositive motions" (motions to dismiss and motions for summary judgment), but Magistrate Judges decide discovery motions. Orly's motion was one for discovery, so it was required to go to Magistrate Judge Nakazato.

Orly's failure to understand the most basic rules of federal practice show that she is a professional embarassment. Her claim that this is some sort of plot against her shows that she is paranoid.

This magistrate Judge might have them come in and attempt to learn whether they can settle.... before it actually goes to court.

While this sounds a little excessive on Orly’s part I have been involved in many lawsuits and have seen things in court that are from another planet.

I have also seen attorneys snooker the other side with sheer skill. I have seen attorneys do things to the other side that they did not realize until it was too late to object. If I understand this correctly, Orly is making sure she to tell the judges she does not want any part of arbitration and she is making it emphatically known sonot opposing attorney can slip something in that will damage the trial.

Before we endict her as a total embarassment and idiot, I know of no other attorney on the planet who has gotten this far on this issue. I know of no other attorney on the planet who has the courage to risk life and everything else to go to the mat on this issue.

To all the naysayers and experts out there, I dare you to do better than she has. Her accomplishments are extraordinary.

1. In addition to other things, I’m a Javascript developer.
2. Taitz has/had a very strange chunk of Javascript code at the end of the source code to her blog page. Such code is consistent with her server being hacked.

Why is there a double-encoded chunk of Javascript at the end of her page? I looked it at using lynx (which doesn’t evaluate Javascript), and it’s actually changed from the last time I checked. I’m referring to the bit that has stuff like this: %3c%73c%72i%70t

I’m kinda leaning towards the Darwinism-in-action response on this one.

Actually, Orly may have confused to what corporate board.

Orly is correct that Jonathan Soros and Google boss Eric Schmidt are on the same board just not on the Google board of directors but on the "New America Foundation, Leadership Council" board:

This woman is insane and dangerous to conservatives. I don't know why people put so much faith into her. That, and her site is constantly infested with Chinese malware ought to start sending off some alarm bells.

Yes another exploit is hosted on her site, again opening a 1x1 "hidden" iframe to a Chinese exploit site.
