This kid did nothing wrong...but he did do something out of the ordinary, and to them, that is suspicious. Based on that suspicion, they presumed wrong doing. Out of the ordinary is not "probable caus," to commit a crime, which is what the constitution says they have to have to search. So, they took his uncommon behavior, ie. simply asking them if giving his name and ID to them was "required," to be probable cause and from that point on, I promise you, they were going to search his car. But he did bait these police, and was attempting to push the limit...and their buttons without doing anything physical. As I see it, he did his thing, and the officers did theirs. He did not give them legal reason to search...but he did (IMHO) intentionally push to see what it would take and they used their own judgment and discretion after that.

HILARIOUS to hear them say, (while illuminating the video device), “it’s running.” Some LEOs are true idiots when they get badge-heavy.

I'm surprised they didn't just take the camera or at the very least delete the video.

If they tried you could say something to them like "Do you think that's the only camera I have recording you?"

Should have stuck with his position of “Am I being detained?” and not given an inch.

Don’t pull over and don’t get out of the car unless LEO can articulate a reason for detaining you. If you decide to get out of the car, lock the doors and take the keys with you.

One must neccessarily be prepared for an extended time with LEO to protect a God-given and Constitutionally protected right.

One of the big problems is most people are not comfortable with confrontation. Police officers deal with confrontation multiple times a day. People can not stand Not answering an officer. They will use intimidation to get you to answer, but if you are not comfortable you will fold.
One of the best techniques I have ever heard was this girl picked up a card of the president of the ACLU and when pulled over she would not comply with the officers demands and would hand them the card and say, my dad is the president of the ACLU and told me to never answer your questions. I am more scared of him than I am of you... they let her go....

I’m curious what happened before the recording started. Was he stopped writhing for his turn, or was he doing something to catch the cops attention before he got to the checkpoint. I have seen people honk, yell or fidget at a DUI checkpoint get pulled aside immideatly.

He made one small but important mistake. When he asked “Am I being detained?” he should have followed up with “am I free to go?”

The latter is a very specific legal question. If a cop says “No,” you ARE being detained and he has to have probable cause to detain you.

As you point out “acting normal” is NOT probable cause.

Next up: lawsuit.

Excellent video. What did they do with your phone/camera after they found it?
Reckless LEOs - and yet their work is inherently dangerous. Even so, they must follow the law.

Actually, when I first saw this yesterday I tried to find such a cloud camera. Closest I came was an android app for a smart phone. I presume iPhones would have the same thing.

I wish there were a standalone camera you could do that with.

Perhaps (as clueless as many of them reveal themselves to be) they are catching on to the growing likelihood that the video had been backed up in realtime on the internet.

Damage or seize property and then it turns out to not be a he said she said thing after all. Don’t think they can claim entrapment on a stop they made.

It was priceless to see the thug “peace officers” find the running video camera.

But I’m sure that the FR Stasi will be checking in to support our brave officers of the law as they figuratively burn the constitution in front of our faces, in order to make the country safe for, um, the Stasi and their overlords.

If you have an Apple device and have ICloud, your photos are immediately transferred back to your home computer and stored there. So you still have the images even if they destroy your device. I believe this is true of vids as well but it could be very data-expensive if so.
