...Powell began with a short opening statement and then responded to questions posed by the 10 active judges hearing the appeal. (Judge Gregory Katsas did not participate in the en banc proceedings.) Jeff Wall, the acting solicitor general, argued next on behalf of the government, followed by Beth Wilkinson, the private attorney retained to represent Sullivan. Powell and Wall concluded with short, two-minute rebuttals.

The questions posed focused mainly on the propriety of mandamus in the Flynn case given that Sullivan has not yet ruled on the government’s motion to dismiss. Mandamus is an extremely rare remedy, appropriate only when there is a clear and indisputable right to relief. Counsel for Sullivan argued there is no need for mandamus because a hearing has not even been held and there is no reason to believe Sullivan will not follow the law. But what exactly the law is, the court pushed the parties to explain.

Was Sullivan required to grant the motion? If so, what purpose is there for allowing further proceedings? Or does Sullivan have the authority to call witnesses and take evidence to challenge the Department of Justice’s decision to dismiss the case? If so, where does that authority end?...

Attny General Barr is setting this up nicely.

The longer the court keeps the Flynn case alive, the longer the DOJ is obligated to produce documents damaging to the case.

He has put it on record that there is evidence that he has as of yet not been able to make public for reasons not specified.

Expect it to become public in the near future.

This will not end well for the court. They are obviously trying to move heaven and earth to keep the Flynn case from being dismissed before the general election.

This is going to backfire on them

Trump can put an end to this at any point, beyond the reach of any prosecution, by pardoning Flynn.

Rendering all the deep state games to keep the charges hanging over Michael Flynn, moot.

If it is done right, the storm would follow within milliseconds; in such a way the Dem party would be destroyed forever.

Depends on whether the Appeals Court is following a script written for them by the Good Guys, or if they are this desperate to prevent what's coming.

In the mean time by a pardon, an innocent man, a true American patriot, would be by law, a convicted felon.

Academia is destroying itself already. Social media is openly censoring Dem candidates. Culture is turning: even Beverly Hills and New Jersey are having impromptu Trump rallies and parades through the lockdown. And nobody, but NOBODY, watches CNN.

There is NO government case - the government walked away.

There is no controversy to be settled by a judge - the judge made stuff up and moved from being an umpire to a self-appointed prosecutor.
