Police smell meth, raid home, kill 80-year-old man, find no meth

Los Angeles County deputies raided the home of Eugene Mallory and Tonya Pate. Authorities claim they had probable cause to search the premises because they could smell chemicals used to make methamphetamine while standing outside the house. Police suspected Mallory of being involved in an illegal meth ring.

Mallory was asleep in bed when police entered his home. Pate said her husband has bad eyesight, and couldn’t tell that the men entering the house were police officers without his glasses. The deputies claim that Mallory pointed a gun at them, requiring them to take defensive measures. They shot him six times, and he died.

Police found no meth, nor evidence of a meth operation, inside the house. They did find marijuana — in Pate’s son’s room.

The sheriff’s department insists that the marijuana vindicates the raid.

“There was a drug operation that was certainly going on in this house,” said Whitmore.

Why do I have the feeling this “drug operation” consisted of one guy’s personal stash?

This thing stinks to high heaven. The coroner “released Mallory’s body to an out-of-state relative, and Pate claimed he was cremated before her own investigators could perform an autopsy.”? WTF would they do that and not to his widow? There seems to be a recent rash of situations where law enforcement or other authorities are arranging cremations that preclude further investigation through autopsy.

Somebody in law enforcement (or their relative/”friend”) had something against this family and the whole “smell” business is likely a ruse and pure bull shit. The widow should be suing for much more than $50 million; she’d get it if I were on the jury and could cause that to happen.

Why a no-knock raid? What was wrong with a warrant and a knock on the door? Grandpa wasn’t going anywhere, they’ve disclosed no sources to indicate a presumption of serious or dangerous criminality, or an ability to hide evidence. No evidence, either.

So I guess if someone is being raided they may as well take full defensive posturing
and kill some executioners before the eventual execution on themselves. No way of knowing
if it's the police anymore with the invention of no-knock.

This event occurred for one simple reason....the badgemonkeys have
learned they can commit these crimes with impunity. They are NEVER
held personally responsible for their conduct. In a small minority of
these criminal actions a lawsuit by the victims prevails. When that happens
the cost and pain is born by the larger subset of victims....the taxpayer.

Unless and until the system is changed to insure these brigands and
criminals in uniform feel the pain personally by doing hard time and
facing real financial penalty NOTHING will change.

If a citizen victim prevails during the combat phase of these crimes he
still loses as no matter what the facts are as he WILL be railroaded for
murdering one of the praetorian guard and the badged criminal will
be lionized and granted the status of minor saint.

Personally.....if something like this happened to a blood relative of mine
I would simply assume hunting season was open and proceed as needed
to harvest as many badgemonkeys as possible.

Given that marijuana is legal in CA, that’s an interesting legal position.
