Section 203-11 of the NYPD Patrol Guide is clear:
“Members of the New York City Police Department will not use choke holds. A choke hold shall include, but is not limited to, any pressure to the throat or windpipe, which may prevent or hinder breathing or reduce intake of air.”

There has to be REASONABLE SUSPICION you committed a crime first before a police officer can make an arrest. This has to be supported with EVIDENCE, of which there was none.
There were multiple witnesses in the area that could have been interviewed PRIOR to him being placed IN CUSTODY.
IN CUSTODY actually means something. It means that the moment they put cuffs on him, those officers were DIRECTLY RESPONSIBLE FOR THE HEALTH AND WELL-BEING OF THE PERSON IN CUSTODY.
That’s why you make DAMN SURE you actually want to arrest someone before you arrest them, because once you do, you are responsible for the person IN CUSTODY, or IN THE CUSTODY OF THE CITY OF NEW YORK CITY.
Now, as for your theory about the poor black man meekly submitting himself for arrest, when they didn’t have an arrest warrant, no probable cause to indicate he had evidence of a crime, and no reasonable suspicion a crime had been committed, just because all of that happens doesn’t mean a lawyer will be provided by the city of New York so that the man can sue the city for him.
Getting a lawyer to actually take your case is a pretty difficult thing to do, considering he can’t pay, which means the costs need to be financed by the lawyer prior to receiving a settlement. This means the lawyer has to be confident that 1) there were damages, and 2) the damages were such that the award would take care of both him and his client. Had he simply forfeited all of his 1st, 4th, 5th, and likely 6th amendment rights just to avoid getting beaten by Precinct KKK, there wouldn’t have been the damages required to get a lawyer interested.
So, that’s the real world, Timmy. Apparently, you slept through your civics classes and spent too much time watching Law and Order, or NYPD Blue. If you don’t assert your rights, you lose them. This guy was tired of it, and he died.

You mean probable cause? Looking at that video I don’t know what probable cause they had to make an arrest. I’m not commenting on their reason or merits for arrest, I’m commenting on the lie that the ‘choke hold’ killed the man. It did not. The man died of a heart attack from most likely overexertion. Autopsy already said he had no damage to his trachea.
Regarding the bit about finding a lawyer, it is not difficult to find an ambulance chaser who will gladly file a civil rights violation lawsuit, happens all the time, I’ve been there several times. You can sue the police for looking at your cross-eyed.
Unless there is another video or further information has come to light, other than the video pertaining to this thread, your comments are speculation and conjecture. Having been in countless incidents like this as a police officer, I did not see anything that would constitute excessive force and the man was not rendered unconscious by the arm around his neck, or ‘choked out’ as it is commonly referred to.
I don’t think the chokehold killed Mr. Garner, but I believe that the autopsy will show that his prone position on the sidewalk resulted in either his heart being unable to beat or he had a lung collapse and died that way...
Being ‘choked out’ does not cause any damage and does not kill, unless the choke is not released and you stop the individual from breathing for an extended period of time.
I have been choked in judo practice and competitions more times than I can count. I have had improperly placed chokes on my neck with no damage.
The man in this video did not pass out from the arm placed around his neck. He keeps saying he can’t breath and watching his hand and body he never goes limp as people do when they are rendered unconscious.
In fact, if you look at the lateral vascular neck restraint and then look at the old school Judo Hadaka Jime, they are different. In Judo the forearm sometimes is placed directly across the throat where as in some chokes and the lateral vascular neck restraint, the elbow points in the same direction as the chin with the forearm and bicep on the sides of the neck.
There will be no doctor fee for this assessment.

I will also predict that this video is going to actually help the police officers. The man is bigger than both officers. He resisted his lawful arrest. He could have easily pushed the officer who had him from behind through the plate glass window they were against causing serious physical harm or death to the officer. The man is never rendered unconscious and they summoned aid for him in a reasonable amount of time.
People won’t like that of course and it is unfortunate the man died but it does happen. It happens to police officers and the people they try to arrest.
NYPD should issue tasers. No guarantee people won’t die from that but it would probably look better and the media won’t be able to (wait, what am I thinking) lie as to the cause of death to incite more hatred between police and minorities.
Bottom line: that chokehold is banned, idiot boy with a badge used it anyway.
But for his actions, the dude would not have died.

I was a police officer for nearly 30 years and practiced Judo and other martial arts for 10.
There was no lawful arrest. There was no resisting arrest. The man died as a direct results of the police taking him into custody.
As a former police officer, maybe you can shed some light on the recent sociopathy of the police. There’s a lot of dead dogs as a result of police ‘fearing for their safety’.
Here’s something else, once the public starts to figure out the police aren’t here to protect you (that’s not their job), and that their REAL job is to apprehend suspects and collect evidence - both of which they don’t do very well of late, they are going to start riffing police officers.
What’s more, they are going to start voiding pension contracts.
Most people don’t know what Warren v. DC is, but once they do, and they connect it with the fact that the police are treating illegal immigrants and terrorists with more respect than they do the folks actually paying their salaries, they are going to start eliminating their public liabilities.

Believe what you wish. We will see what happens when it’s over with. I don’t care to defend or condemn the actions of every police officer across America, especially when the only story is the one sided, tainted media version. When I believe a cop is in the right, or the media is twisting things to suit their agenda I say something. When a cop does something wrong I will say I think he needs to be fired or sent to jail.
