Bingo. It will come down to the psychological tunnel-vision of not being able to reel back in his shoot/don’t shoot decision in the chaotic flux of life and death. The state had better give jurors the option of lesser charges or Slager walks.

“Police allege that during the struggle the man gained control of the Taser and attempted to use it against the officer.”

I looked at the article and I see where Slager says Scott grabbed his taser. I don’t see where he claimed that Scott had tased him, which is what the poster I was replying to thought had happened (that is, that Scott had tased Slager). You might be right about the time to reload.

I can’t figure out why SLED hasn’t released Slager’s statement along with that of the other cops.

I would hate to think that it is “political”! (sarc)

Do all murder suspects get the chance to go home and jot down their thoughts prior to making a statement?

Murder suspects don't have to give a statement at all.

Since he is required to give a statement because the shooting arose from his employment he is given time to consult with legal counsel prior to making any such statement.

Okay, I see his statement from the other link now.

So that basically agrees with how I’ve understood the situation. Namely that Scott grabbed the taser but did not actually tase Slager.

Does anyone know how long before this will go to trial?

It really bothers me that we might not get all the facts for months, except by the BGI gang, and are left with only their and the media’s spin and manipulation.

You do realize that the word “attempted” means he failed to actually tase Slager, right?

Are you saying that it is standard operating procedure to let a murder suspect go home for a few days prior to being arrested?

Why don't you read my post again and tell me if that's what I said.

I will say now, though, that yes, murder suspects often do go home until investigators are comfortable that they have a solid case.

Look....I dont think he “intended” kill him when the stop occured....he didnt set out to Kill scott...

But he did make the decision to unload his weapon into center mass of a fleeing perp.

And that decision is what will be contested in Court.

Moving the taser will probably convict him.

Yes, if that was the reason for shooting. There could be other valid reasons, as well.

then the cop realizing that the taser is now useless, throws it down in order to pull his gun.

It's possible while reaching for his gun, with taser still in hand, with his hand moving downward and back towards his holster, in one motion throwing the taser towards his rear and grabbing the holstered gun nearly at the same time.

That’s how I imagined the training is. Get it out of the way upon failure.

Yes, if that was the reason for shooting.

He was unarmed and fleeing. He was no threat to anyone.

There could be other valid reasons, as well.

For example?
