Can Texas legally secede from the United States?

Hey, Texplainer: Britain voted to leave the European Union. Can Texas secede from the United States?

In the wake of Britain’s historic vote to leave the European Union - nicknamed "Brexit" - speculation of a Texit on the horizon have cropped up once again. The secessionist movement has a long history in the Lone Star state. Delegates for the Texas Republican Party even recently debated adding secessionist language to the party's platform. But is it actually legal for Texas to leave the United States?

Simply put, the answer is no. Historical and legal precedents make it clear that Texas could not pull off a Texit - at least not legally.

Hey, I am just telling you the law. Texas v. White is the controlling case and has never been overturned or even challenged.

The only LEGAL mechanism for departure from the USA is secession, which will undoubtedly be violent (since there is no other way to leave).

Sorry to rain a little knowledge on your urban myth.

Several years ago, Putin predicted 6. (I found several links to Igor Nikolaevich Panarin's 1998 prediction along those lines, but don't see the Putin reference that I recall). Of course, Panarin apparently predicted it would happen in 2010, so he's a few years off.

When Texas joined the US it gave up any and all claims to independence. It is a State within the United States. No more, no less. Equal to all the others and bound by the same laws which establish our Republic.

I declare my independence from you, because you are purposely trying to destroy me.

Done with you. Bye. But if you think you are going to continue to control me despite my leaving you, then you are going to have to come kill me, and believe me when I tell you, I will defend myself.

America wasn’t legally allowed to separate from England, either, but we did it anyway.

The fact is, a people, any people, have an inherent right to separate the political bands that tie them to a larger political union, should they determine that that union has become detrimental to their well being.

Well, that may be so today, but IT is what began all of this. Those who give it no legal value do not admit or understand what created the American Revolution.

The statement:

“We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights”

Was held to establish that those rights are not granted by government but by the Creator. I know the Leftist pukes deny he exists, but that changes nothing.

The courts have no authority on those issues.

Any state can legally secede from the union. Period.


So then, was the Civil War illegal?? That war forced the southern states to return to the union.

Armed conflict wouldn’t get past the saber rattling stage, in this day and age, over a purely political question.

If Texas truly made up its mind to leave the union, Washington DC wouldn’t do more than issue a bunch of stern letters.

But we didn't do so - not legally anyway. We openly rebelled against their authority. And we took up arms to defend that position.

Use reason here. If states don’t have the option to leave, their people are not free.

Why would it be acceptable for an Estonia, Ukraine, Caledonia, Scotland, or Quebec to leave their unions, but not, say, a Delaware?
