[Vanity] Could repeal of Second Amendment be a breach of contract?

Posted on 06/27/2016 3:06:31 AM PDT by Jonty30

If, under a Hilary government, the Second Amendment was read out of the Constitution or Amended to be null and void, could the South leave?

Those who joined the Union did so with the Constitution as it was written at the time, so those were agreed upon terms. However, it seems to me that a repeal of the Second Amendment represents a change to the contract, needing all parties to agree to the change or it becomes a breach and allows parties to decide to stay or not.

Am I wrong?

No, because amending the Constitution requires the approval of 2/3 of the states, and that process was part of the original Constitution those states agreed to.

If Hillary simply declares the Second Amendment “null and void” that is a different matter entirely, and would result in court action before secession.

Nope. By your own statement, the Constitution at the time included the power to amend the Constitution. So, as long as the replacement Amendment were passed according to the proscription for the amendment process, the answer is no.

What if the south did secede again? Would the north fight this time? Would it win?

It is a mistake to think our rulers are concerned with contracts, law, ethics, or morals.

They are Machiavellian power seekers, and will do whatever they think will maintain their power.

I see multiple states north and south excluding NE and LEFT Coast rejecting any attempt at deleting the 2nd. I personally will move to the first state that secedes from an unconstitutional America.

Depending on their immigration laws and how strictly they are enforced.

The law on secession is simple. If you win, it was legal. If you lose, it was treason. Fortunately, the liberals who want to control our lives are sissies. I don’t believe they would fight.

If the Free States (whatever states that turns out to be) secede, I think they will be permitted to leave peacefully. The left has repeated their mantra that the flyover states receive more than they pay in federal taxes so much that (1) they believe it, and (2) they think that is what matters in a federal relationship.

We have just cause to secede already.

If Hillary has the nuclear codes then the South would be a radioactive wasteland while the North would be under Sharia law.

They’ll have someone else fight for them.

Why do you think the left is so coddled up to illegal immigrants so closely?

The left has their willing warriors.

marktwain: “It is a mistake to think our rulers are concerned with contracts, law, ethics, or morals.”

This bears repeating, because it is absolutely true. The left has consistently amended the US Constitution by fiat. All they need are five votes on the Supreme Court, and they can do whatever they want. Let’s not even pretend that legal arguments presented to the court have any effect whatsoever. The political operatives know what they want, and they enact it. Period.

What if they don’t have the votes? Well, then the left engages in civil disobediance and violence. They use the law against us only when the law serves their purposes. Otherwise, they resort to whatever means are necessary to get their way.

It’s very important that we do not lose sight of the kinds of people we are dealing with. They are not American! They are actually counter revolutionary, anti-Americans who seek to impose global government by whatever means are necessary. They believe they have the moral right to impose their will, because they are good, noble, and right, and we are backward, ignorant, rubes.

The South is no longer your Great Grandpappy’s South. Demographics has shifted too much; industrialization, migration from the north and west, immigration, social media impact, on and on. Window for secession shut several years ago. Now, if you want to talk about states evolving into semi-autonomous blocks meaning less federal control and more states rights then that has possibilities. Texas seems to be evolving along this path right now in fact.

Historically, mercenaries are no replacement and no match for those who fight for their own interests. The thugs on the left could well recognize this and back down rather than insisting on a second Civil War. In the event that Hillary's voters put her within the margin of fraud to steal the election, it may be well worth finding out if I'm right.

I will plea my case with my truck festooned with patriotic bunting and bristling with those 2nd amendment devices that I will promise to use to defend the 2nd and the state.

But I like your point.

They won’t need to repeal - they just have to stack the SCOTUS to give them the power to do whatever they want. Unconstitutional? Yes, so what, it hasn’t stopped Obama.

I don’t see any success in secession or civil war. It would be asymmetric and look a lot like terrorism.

Wouldn’t expect it from fat dumb and happy ordinary americans. Just opportunistics and infiltration of foreign provocateurs and the lone wolf fighting a personal war.

Yes.

For example, imagine Brexit had LOST 52-48. The subject would be closed, forever, and within six months it would be a punishable hate crime to ever bring it up again. But, since it won, voting again, or ignoring it altogether, is simple common sense.
