Justice Thomas: 'The court is 'avoiding' the Natural Born Citizen question.

A curious thing happened in the Supreme Court budget hearing yesterday. Rep. Joe Serrano went on a long monologue about 'diversity' in the court and even said he would be glad when the day came, that a Puerto Rican could be president...to which Thomas replied that the court was avoiding that question. Nervous laughter ensues and the topic is quickly dropped. I'd like to know what my fellow FReepers think of the exchange.

It happens around the 1:13-1:14:10 mark in the video. It would be great if someone could isolate that exchange and put it on YouTube so everyone could hear it without sitting through the entire hearing.

This is true. However, a Puerto Rican candidate would have to move to the mainland, should he want to vote for himself.

Hmm, there is a requirement, 12th amendment that the Presidential and Vice Presidential candidates not be from the same state. (Actually the requirement is that an elector cannot vote for both a VP and Presidential candidate from the same state as themselves.) But I guess with someone from PR, or Guam for that matter, on the ticket, that would not be a problem, since they are not from the state as any elector.

An interesting question would arise if both candidates were from DC. DC is not a state, so could the DC electors vote for them, or not. Clearly the intent of the provision would be violated if they could, but not the letter.

Puerto Rico is a Commonwealth, a Internal self-governing, unicorporated territory of the United States.

The question of whether or not a Puerto Rican is qualified under Article II to run for,and serve as POTUS is a damned good one.

Based on the strange body of law known as "The Insular Cases," IMHO, the probable answer is "NO."

SCOTUS needs to grow a pair and stand up.

No argument there, unfortunately, it seems with Stephens imminent departure, the court will be headed in exactly the opposite direction from the brass ones. We shall see.

Note Thomas’s use of the word “evade” vs. “avoid.” He is very intelligent and very articulate, so I must assume he did this on purpose. I can’t tell for sure if he was joking about the subject matter or not, but as far as word usage, according to Encarta:

“avoid, evade, or elude?

All three words involve keeping away from a person or thing or keeping a person or thing away from you. The main difference between avoid and evade is that avoid is neutral in tone, whereas evade implies dishonesty or deception, or at least some sort of ulterior motive. If you avoid a responsibility, you take measures to prevent it from being necessary, whereas if you evade a responsibility you get out of it in an underhanded or deceitful way.”

their REFUSAL to hear these cases angers and frustrates people who want our constitution protected and that alone will lead to a civil war on the OTHER SIDE of the spectrum. Do they not see this?

Imo they have been betting on a couple of things:

-the BC controversy arose before the election, and the rumblings of civil unrest worked back then, and didn't affect the election of the usurper. Since the tactic worked in 2008, they continue to hold that card;

-the thugs in Philly were an extension of the threats that Acorn/SEIU/Black Panthers would get violent if his eligibility was challenged. Black panthers brandished clubs outside voting areas, and the lack of prosecution affirmed that the thug tactics would go unpunished;

-they are betting that "bitter clingers" will cling to but not fire their weapons;

-the Marxofascists have been trying to provoke TEA partiers into doing something stupid so that martial law can be imposed. They don't avoid provocation, they engage in it;

-If there is a CW in the cards, there will be a great deal of posturing and maneuvering to get the other side to fire first. The significance of that is self-evident.

Thus, The Court continues to "evade" the issue.

BTW is Kenya, Haiti, Indonesia some of the 57-60 states Obama mentioned?

Thomas meant that: If a KENYAN can be POTUS I guess a Puerto Rican can also.

That is what Justice Thomas meant when he said we are giving you MORE OPTIONS.

SCOTUS can't do anything UNLESS it is brought in front of them. They can’t file cases to hear or make rulings without having an issue brougth to them. Meaning they are powerless to initiate actions/filings their only power is to make rulings of issues brought to them.

I bet if Tim Turner brought an Eligibility Case as a Sovereign American he would have STANDING and it Would be Heard.

We should find a foreign born conservative to try and get on the presidential ticket in 2012 and then just sit back and watch the fireworks....LOL!

I wonder if Mark Steyn would be interested? Perhaps Mr. Hanan from Britian? It would only be done in a few key states to smoke out the constitutional hypocrites...lol. Then..if the Obots howled..this candidate would have standing to insist on seeing Obama’s BC. /half joking

I can see that the man is laughing..yes.It doesn’t mean that what he said isn’t true. The courts are ‘evading’ this issue.

Of course it’s lame, but I don’t blame Thomas for it. I blame Obama,his henchmen and lapdogs. I actually rather appreciate the fact that Thomas had the spine to mention the truth. The courts ARE EVADING THIS ISSUE...BIG TIME!

Has anything ever been reported what that "secret" meeting with the SC judges was all about???

The "brain" surgery scar on the usurper is visible on this photo and we don't know about that medical procedure either!!!

Chief Judge Lambreth just ruled that the only people who have standing to bring a quo warranto are the Attorney General, the U.S. Attorney, and the person claiming to be the rightful holder of the office (which would be Biden).

Except Biden didn't run for that office so he can't claim to be the rightful holder of it. Perhaps the rightful holder is McCain.

Me too. Puerto Rico is, after all, an American territory.
