Research - Vattel & the meaning of the Constitutional term "Natural Born Citizen"

Article II, Section 1, Clause 5 from the U.S. Constitution states:

"No person except a natural born citizen, or a citizen of the United States, at the time of the adoption of this Constitution, shall be eligible to the office of President; neither shall any person be eligible to that office who shall not have attained to the age of thirty five years, and been fourteen Years a resident within the United States."

To be clear, the intent of the our founders was not for what we have today. Someone whose father was born in kenya and is a citizen of the British crown.

The following gentlemen were involved with the Federal Constitution in some capacity, in the beginning. We know some of them wrote about their experiences as they, and they're writings are well known.

Others are not as well known, but may have written about their experience and may have discussed the term "Natural Born Citizen" and/or Vattel as they were either involved with the Federal Convention, and/or the several state's conventions convened to discuss and ultimately ratify the U.S. Constitution.

They're wives or other family members may also be potential sources if they wrote about their discussions and experiences with these men, related to this issue.

Looking for the source for your exhaustive listing of ratifiers I came across the federal annotiations accompanying the Constitution. Surprise surprise. While we all know that the term was common law, so do the archivsts and legal authorities at the Library of Congress. Here is the relevent quotation:

456 ART. II—EXECUTIVE DEPARTMENT Sec. 1—The President Cl. 5—Qualifications QUALIFICATIONS All Presidents since and including Martin Van Buren were born in the United States subsequent to the Declaration of Independence. The principal issue with regard to the qualifications set out in this clause is whether a child born abroad of American parents is ‘‘a natural born citizen’’ in the sense of the clause. Such a child is a citizen as a consequence of statute. 100 Whatever the term ‘‘natural born’’ means, it no doubt does not include a person who is ‘‘naturalized.’’ Thus, the answer to the question might be seen to turn on the interpretation of the first sentence of the first section of the Fourteenth Amendment, providing that ‘‘[a]ll persons born or naturalized in the United States’’ are citizens. 101 Significantly, however, Congress, in which a number of Framers sat, provided in the Naturalization act of 1790 that ‘‘the children of citizens of the United States, that may be born beyond the sea, . . . shall be considered as natural born citizens . . . .’’ 102 This phrasing followed the literal terms of British statutes, beginning in 1350, under which persons born abroad, whose parents were both British subjects, would enjoy the same rights of inheritance as those born in England; beginning with laws in 1709 and 1731, these statutes expressly provided that such persons were natural-born subjects of the crown. 103 There is reason to believe, therefore, that the phrase includes persons who become citizens at birth by statute because of their status in being born abroad of American citizens. 104 Whether the Supreme Court would decide the issue should it ever arise in a ‘‘case or controversy’’—as well as how it might decide it—can only be speculated about.

Perhaps I should clarify why the statement quoted in #150 is significant. Clearly, the comments by the U.S. attorneys do not mention the repudiation of the 1790 Naturalization act in 1795. But what they do say is that a naturalized citizen is a citizen by statute, and thus not a citizen by nature - not a natural born citizen. They opine that the Congress and the Framers in 1790 presumed that part of being natural born was having two citizen parents, and presumed that the definition descended from English Common law. The conjunction of those statements, and the fact that the 1790 law did not survive or become an amendment meant that not being born on the soil of two citizen parents meant not being a natural born citizen. QED

While there are many legal scholars of the time, James Wilson for example, and probably John Jay, and Dr. Ramsay, who would probably disagree with the assumption that our notion of natural born citizenship descended from English common law. How our contemporary legal scholars interpret “natural born citizen” is the important issue here. Legal historians working for our government agreed with us in 2003. Obama’s cadre obviously haven't yet scrubbed government archives. This statement, the one from note #150, is from the last set of commentaries on the Constitution hosted by Congress and paid for with our tax money.

Says the same as the original 1758 edition. Slight differences in capitalization.

Les naturels, ou indigenes, font ceux qui font nés dans le pays, de parens citoyens.

I downloaded and ran Acrobat Pro's OCR tool against it. Still had to clean even that little bit up some.

perhaps a new thread should be posted Subj: The Founders understood naturels to mean natural born.

This is the only way to get this info out of free republic and posted on other blogs.

Suggestions on the title of the thread and how to proceed with the links to the congressional record. When I post usually make typos and my sentences are horrid.

Suggest rxsid make the post. The 1773 edition was located
and El Gato posted the words are the same as the 1758 edition.

The other options are locating the manuscripts of Thomas (1770-1771) Nugent to see if he actually was the translator of the 1797 edition as reported here:

Was hoping for a miracle in the 1773 edition with the Dumas notes,...there seems to be a second part of this edition.

There was/is a manuscript by Jefferson translating Montesquieu, Spirit of Laws: http://www.choosebooks.com/angebote/montesquieu-spirit.html

It is reported Nugent translated Spirit of Laws..

Is there link to Nugent and Jefferson? Did Jefferson translate the 1797 Le droit des gens?

According the "advertisement" of the 1797 translation, it was based on the 1773 edition.

It contains a practical collection of ethics, principles, and rules of conduct to be observed and pursued, as well by private individuals as by states, and these of the utmost practical importance to the well-being, happiness, and ultimate and permanent advantage and benefit of all mankind; and, therefore, ought to be studied by every gentleman of liberal education, and by youth, in whom the best moral principles should be inculcated. The work should be familiar in the Universities, and in every class above the inferior ranks of society. And, as regards lawyers, it contains the clearest rules of construing private contracts, and respecting the Admiralty and Insurance Law. The positions of the author, moreover, have been so sensibly and clearly supported and explained, and so happily illustrated by historical and other interesting examples, that the perusal cannot fail to entertain as well as instruct. The present Editor, therefore, affirms, without the hazard of contradiction, that every one who has attentively read this work, will admit that he has acquired a knowledge of superior sentiments and more important information than he ever derived from any other work.

Photobucket Vattel appears to be placing les citizens and les naturels differently. We know naturels means natural born. This is clear all citizens are not naturels e.g. natural born.
