“Factually Correct, Not Politically Correct”

Hawai’i judge conducts vigorous hearing on Obama birth certificate battle, reserves ruling

Andy Martin will launch a “National Conversation on the Future of America” Wednesday evening in Honolulu

(HONOLULU)(November 18, 2008) Aloha from Hawai’i.

A Honolulu circuit judge heard vigorous arguments in the lawsuit filed by Obama author Andy Martin. Martin is seeking access to Barack Obama’s original, typewritten 1961 birth certificate. The judge reserved judgment.

“We had about a half-hour hearing,” Martin states. “Both the Attorney General and I vigorously presented our respective positions. The Court gave no indication of when or how the ruling could come or what the result will be.

Justice Souter tossed it only because of a procedural technicality, not based on the merits of the case.
The stay clerk listed the last court as the NJ Appelate Court not the NJ Supreme Court which was the reality. Under the SCOTUS rules all the lower courts avenues have to be pursued before an appeal to SCOTUS. Justice Souter saw this error from the clerk and denied based on that. There is no reason to believe that Justice Souter took the time to read and study the case when he thought it didn’t meet the procedural requirements.
Now as the case goes to Justice Thomas there are no procedural issues and he can look at the case itself.
BTW, the other Justices also were sent copies by Donofrio as required by the SCOTUS rules when a case is resubmitted.

Thanks for clarifying that. I could never really follow what Donofrio was saying on his website about the clerk’s actions in the original filings. I was very unclear as to the reason for the swift dismissal by Souter.

Our family has written a letter to Justice Thomas requesting his attention to the case. Hopefully thousands of others have done the same.

I have also written a letter to Jus. Thomas.
It is a positive at least that the case was resubmitted on Friday and is still pending. If it was going to be immediately dismissed it would have happened already.

Are there any other lawyers in Hawaii or at least in CA who can file a betetr case and make a better argument in the Hawaii courts than Andy Martin?
There must be some attorneys on FR who are in Hawaii or California.

I’m going to make a prediction. This will dog Obama for the next four years. He’s not going to be like Clinton with sexual escapades - which a majority of men smirked and winked at. This will dog him and eventually most Americans will start to question this. Especially as the USA starts going down the tubes. I learned during the Clinton years that Americans care not one whit for personal failings as long as they perceive the economy to be good. As prices rise and rise, as the stock market goes down, as companies start to fold, Americans will become disillusioned with the One.

I agree—everything from Obama’s past is going to dog him. One that I’ve been recently intrigued by is his Selective Service registration. If you go to Debbie Schlussel’s site, she makes a very compelling case that he filed his Selective Service registration THIS YEAR, not in 1980, as he (and the Selective Service) asserts. And although no one denies that failure to register for the draft is a Federal offense, it’s one the SS administration readily admits that no one prosecutes. (Glad to know this as my son turns eighteen in a few weeks) However, the real issue is not his failure to register in 1980, it’s the forgery in 1980 that’s the crime. Is it not a federal crime to forge a Federal document?

Sounds like your describing Barney Frank and it doesn't seem to have stopped him.

Totally made-up "diagnosis". It means absolutely nothing. He was not diagnosed. It's the professional equivalent of sticking out your tongue at the guy and saying "I think you stink, na nanna boo boo."
