He needs to understand as frodo did that it is the burden of carrying the ring falls on one person and no one else can carry that burden for him and if he falls than the darkness will desend on all mankind and the darkness will prevail.

I wasn't thinking of Frodo Baggins, but had a similar impression a few minutues ago reading this. Perhaps Leo Donofrio represents that long, fragile and "bruised" reed of grace invested toward the time of need.

That depends upon what the deadline is/was.

Also:

1. The entire SCOTUS referred Donofrio v. Wells to conference, after Justice Thomas received it.

2. Wrotnoski v. Bysiewicz is meant to complement (in one way or another) the Donofrio suit and in Donofrio's opinion, presents a case more likely to be heard.
