Is the Judicial Review Allowed ONLY After the Electoral College Vote and Congressional Cert?

Is this why the Donofrio v. Wells (NJ) case is still pending? Is it only after the Electoral College votes and Congress certifies the election, that the Supreme Court believes it may take action regarding the eligibility of presidential candidates? The cases currently before the court, except for the Berg (PA) case, are versus state secretaries of state, not against Barack Obama, but perhaps that does not make a difference.

Is it similar to a prosecutor only allowed to prosecute after the crime and not before?

I understand what you are saying, and it is a shame we don’t apparently have any reasonable way to truly vet such issues, nor have leaders who support finding a better way.

Okay, let’s use Nehemiah as an object example, in light of this Obama “qualification” to be President of the United States.

If I were to “apply” Nehemiah and his building of the walls of Jerusalem, to the present situation — it would be to not wring one’s hands about the state of affairs of the Constitution and worry about whether Obama is going to be President or not...

I would “build the walls” and continue doing what is needed for the correct application of the Constitution — from here on out — and forget about Obama.

Nehemiah wasn’t trying to close the barn door after the horse got out. He was building the walls so that Jerusalem would be protected *in the future* — after the walls were built.

SO..., in light of that application — the Obama horse has already gotten out of the barn. The Constitution is not dead, and it needs to be “reinforced” with some “wall-building” so we don’t let the “evil-doers” win like this in the future...

Now, that’s what I call a much more *productive* application...

The Constitution is not dead... “Build the walls” (of the Constitution); forget the horse that got out of the barn.

At this point in time, I think the best way to work through this problem is to use the obvious “energy” that is here on this issue, and get some state laws passed that require the Secretary of State to vet a candidate (for the Presidential election, and any other election requirement for other offices, too) before they can legally be put on the ballot.

And if someone is not legally vetted, then anyone who tries to vote for them, even if a write-in, then they can’t count that vote (for that candidate, that is...).

It’s necessary to do that, at this time, since we see what can happen...

What???? So then ignoring a fundamental qualification for President right there in black and white in front of all of us is the first step to building the walls??? Get real, it merely creates more destruction. How about we start right now rather than wait. How about closing the barn door right now rahter than tomorrow. How about closing the breach in the wall right now before more damage is done by the one exploiting the breach.

No it hasn't??? He is only the President elect who has not yet qualified according to the Constitution and the 20th Amendment thereof.

And the place to start is right now and right here not in some neverneverland or nevernevertime of time but right here and right now on solid terra firma.

I’ll choose to work on putting a mechanism in place to vet candidates *before* the election so that we don’t have this problem with a Constitutional issue again. That’s where my work will be.

[AND..., I’ll keep saying that you’re beating a dead horse, whether it’s right or not. By the way, have you ever heard about William Ayers? I thought so. Is he in jail? I didn’t think so... That’s an example... Why aren’t you doing something to put Ayers in jail? Well, because it’s “beating a dead horse”... you’re simply not going to be able to do it... or haven’t you figured that out yet. It has nothing to do with right or wrong. There’s a point at which you can’t do a particular thing you want to have done, even if it is the right thing to do... ]

It’s all fine and dandy to “build walls” for the future. And maybe we’ll see some significant energy directed to this goal in the future.
But a plan for four years down the road has NO bearing on immediate issues.
You can plan on buying a new car in four years but that doesn’t address the flat tire you have now.
I’m still in favor of trying to fix our current flat tire.
And if someone wants to stop and help, fine. Otherwise I will work on the tire myself.
In the current context, I’ll continue pushing to have the constitution upheld regarding BO’s eligibility.
If people want to drive by and give me the finger (or call me a tin hat nut case) that’s OK.
And some like to say “drop this and work on real issues”.
Sure, I’d like to dress up my ride too - but I still want that tire fixed.

I stopped putting in the same duplicate post when I was notified on this before (a bit earlier, yesterday, I think). Since then, I’ve been simply responding to the other posters on the subject matter, that’s all.

However, I do have the same several “themes” that I am responding with (about three or four themes on the issue). But, I try to respond uniquely on them.

I think that’s proper, in what I’m doing now..., since I’m replying to people who post back to me... Let me know if that’s not right... I’ll try to find out how to respond with my ideas. Thanks...
