Judge Carter Refuses To Dismiss [WARNING: THIS STORY IS A HOAX]
The Obama Files ^ | 10/24/09 | The Obama Files

Posted on 10/24/2009 12:32:31 PM PDT by American Dream 246

In a move that has the Plantiffs "amazingly overjoyed," Judge David O. Carter has turned down the Government’s motion for Dismissal in the case of Barnett vs. Obama.

"This is a victory for democracy and the people of America," Rancho Santa Margarita-based attorney Orly Taitz said after this morning’s early meeting in the Judge’s offices.

"This means that, come January, the President of the United States will be forced to come into this same courtroom and explain his massive fraud to the American people."

Taitz represents Capt. Pamela Barnett and other military officers who question orders from the commander in chief, as well as Presidential Candidate Alan Keyes. She has tried similar lawsuits elsewhere, but has failed, most recently in Georgia, where U.S. District Court Judge Clay Land not only rejected the lawsuit Taitz filed, but then fined her $20,000 for filing a "frivolous" appeal.

Taitz is joined in this lawsuit by Ramona-based lawyer Gary G. Kreep, who unsuccessfully tried to sever his case from hers.

"I’m astounded, quite frankly," Kreep commented. "I really thought, after the last Court session, that we weren’t going to get this far. I guess I should have given Judge Carter more credit than I did."

The case revolves around whether Obama was born in the United States. In the previous hearing, in which the Government presented its Motion to Dismiss the case, Carter seemed skeptical that a courtroom was the appropriate place for such a matter to be decided.

Department of Justice attorneys Roger West and David DeJute had argued that only Congress can remove a president through impeachment. The only way the courts could be involved was to have the chief justice of the Supreme Court preside over the impeachment trial.

Both West and DeJute refused to comment.

This item is just breaking and I would consider it as "Not Verified." There are only a couple of sources on the Internet at the moment, and Taitz doesn't have a comment on her blog.

"When the day comes that this issue gets settled correctly, I know I will find you silent and cowering under your bed."

And, wherever there is kooky-talk, I know that you'll be there.

And, "when this issue gets settled correctly", where would you like to have your Xanax mailed? My guess is, you'll need it by the handfuls.

I thought you never insulted? When you can’t discuss you resort to insults? I was duped by your pseudo legal posts. Never again.

“I believe down in my soul that this eligibility issue with Barry will one day break wide open and the truth will be revealed...I pray that everyone who is setting up roadblocks to stop this from happening will pay for what they are doing. (This includes these Barry trolls who slither their way through FR).”

My God, that's clinical.

You believe something deep in your soul. That's fine. We're sifting facts, and right now, we simply don't see how those facts line up to support what you so desperately want to be true. So that earns hate-filled prayers?

Nice religion you've got going there. But rest assured, I won't retaliate in prayer, because I don't think a merciful God appreciates that sort of stuff: “Judge not, that ye not be judged. For with what judgment ye judge, ye shall be judged: and with what measure ye meet, it shall be measured to you again.” If I'm not mistaken, that quote belongs to a person of some significance in the Christian religion.

I wonder if Rush, Sean, Michelle, Fox, Glenn, Mark and others will finally cover this story?

What a rickrolling?

". . . . Hmm, who would set up a hoax?"

Somebody who has a fetish for "rickrolling?" Like, perhaps, a juvenile?

"I thought you never insulted?"

I never insult, first. If you had taken the time, or had the inclination to read the insulting post that I was responding to, you might have figured that out on your own - and before you lobbed your own gratuitously insulting post - that again I'm forced to respond in-kind to.

The only one doing any duping is Orly Taitz and her band of useful idiots - whom she frequently calls on for Paypal donation to support her idiotic and distracting legal challenges - challenges that are used by the media to portray all conservatives a Taitz-worshiping morons.

She and her sycophantic followers are a disgrace to thinking conservatives everywhere. If Buckley wasn't already dead, this reincarnation of "Bircherism" surely would have killed him.

Even after 50-plus lawsuits dismissed and $20K in sanctions (so far), when right-thinking conservatives (to include Mark Levin, Rush Limbaugh and Ann Coulter) either ignore, or criticize this ludicrous "cause", they're called traitors, Obots or worse. It would be funny if it weren't so pathetic.

I pray for the truth to come out. I pray for the plans of people who obstruct the truth to be defeated.

My post above and this post is not a threat. These are the prayers I pray everyday concerning this issue.

My Religion is very nice. Thank you for asking.

Whether you like it our not, God will let the truth be known at some time. You wanting to hide the truth and me wanting the light shown sooner doesn’t matter.

I was just letting you know that many Americans are praying for truth and justice.

Why did that bother you so much? Is the Holy Spirit trying to tell you something?

Don’t you ever post to me again if you are going to put down my prayers.

I did read who commented to you. I have been reading your posts for awhile now before posting to you. I wanted to be sure. You get unnverved when you lose and you start insulting. It’s a problem with Obama’s and his administration too.

If Orly bothers you so much then I would find a thread that you enjoy. This is America and we have a right to fight what we think is wrong. Whether you think it is done right or not. To come into the discussion each time to argue something that is not going to go away you must be a terribly frustrated wanna be attorney.

I think the lawsuits are over 100 by now. Nixon did not go down easily either. 11 went to prison. A small amount compared to the corruption in Obama’s administration.

I see you read the WSJ Bircher/birther article so now you act like you have some vast knowledge of history. The journalist on that story had none of the facts correctly either. He has the facts now but you won’t see him correct his story. His article was to support Obama and his facts were given to him by Obama admin.

"I see you read the WSJ Bircher/birther article so now you act like you have some vast knowledge of history."

Sorry sweetie. I've been talking about the Birther/Bircher connection for almost two months now. You can look back on my posts and find numerous mentions by me of John Birch and his band of whackos and the fight Buckley waged to eject them from the movement.

And, I haven't lost squat. Once again - not a single lawsuit has prevailed - not one.

"If Orly bothers you so much then I would find a thread that you enjoy. "

Oh, I enjoy this plenty. I find her and her band of merrymorons to be most entertaining.

More like a dozen. Maybe two dozen tops.

Orly Taitz is an attorney. An attorney takes an oath not to violate the law or the Rules of Professional Conduct, no matter how noble the cause she is fighting for. As a member of the California Bar, I am offended by Orly's conduct, which brings all lawyers into disrepute.

You are making assumptions about people and acting as if they are fact. You appear to presume the people who disagree with you about a factual issue must have false motives when they do not. You are branding other people as dishonest and evil when they are not. I believe the Bible's opinion on such matters is pretty clear.

People praying for truth and justice never bothers me. I have no problem if Obama has to provide a long form birth certificate to someone. I sincerely doubt the facts revealed would accomplish what you believe, but if they did, that would certainly be interesting.

People using the words truth and justice as cover to sate their own emotional needs is a different matter altogether. History has seen far too much of that, which is one reason the legal system so many decry is designed the way it is.

Oh and by the way,

Good going signing up on 2009-10-03 just so you could come on board and knock FReepers Religions and prayers with your “know-it-all” attitude.

I know that many of the members of FR appreciate prayers on this board.

Take your “sort of stuff” and go play somewhere else.

“What a rickrolling?”

It is explained early in the thread. The Obots are using it to distract from the thread by claiming this is a hoax. Rickrolling is when you post a story then link it to a site that plays a video by someone that is a song and not the story. In this case it isn’t true. But as I said it is used to make people who come to the thread think it is a hoax thread.
