The photographer who shot the picture violated his contract by reselling them to Newsweek. That photographer, Brian Adams, could not immediately be reached, and his agent, Kelly Price, declined to comment, saying, "I keep all of my clients' business private." But a spokeswoman for Runner's World confirms that Adams's contract contained a clause stipulating that his photos of Palin would be under embargo for a period of one year following publication -- meaning until August 2010. "Runner's World did not provide Newsweek with its cover image," the spokeswoman said. "It was provided to Newsweek by the photographer's stock agency, without Runner's World's knowledge or permission." The spokeswoman declined to say whether Runner's World intends to respond to Adams's breach of contract with legal action.
But while Adams clearly violated his agreement, it's not clear he did so without Runner's World's consent. A source with knowledge of the situation says multiple outlets, including Time, approached Runner's World after the photos first appeared on its website in July to inquire about obtaining the reuse rights.
A Newsweek spokesman says, "We purchased the photo from an agency and were not aware of any issues with it."As for whether the Newsweek cover is, as Palin says, sexist, editor Jon Meacham addressed that accusation:
Newsweak did not run photos like this one of the man-child president on the cover.
But these tactics are OLD OLD OLD in the media. Frank Capra addressed such media manipulation in "Mr. Smith Goes To Washington" when Mr. Smith is likewise made to appear foolish and wrong for Washington.

That was the contract between Runner's World and the Photographer which means RW could sue the photog for illegal distribution but maybe Palin doesn't have standing?
More importantly is the contract between Palin and RW regarding the disposition of any photos they took to accompany the interview.
For some reason, Palin’s camp is strangely silent on the issue other than to accuse Newsweek of being sexist. How come they didn't concurrently announce that the photos were used in contradiction of the terms of her contract with RW?
Contracts of this nature routinely contain a clause that any photos taken in conjunction with an interview be used for that purpose only and within a restricted time frame and always, at least with a celebrity like Palin, that any further use cannot be made without expressed written consent.
So I'm very confused about this. Did Palin’s contract with RW contain the usual and obligatory clauses that allowed her some control over their later distribution?
If not, then why is she going down this “sexist” route? Did Newsweek conduct a photo shoot with Palin in order to secure pics they could use for the article and cover? If not, what photos did Palin expect them to use?

Yes - “Man-child” is a very good epithet for Obama.
“Narcissistic” “Spoiled rotten, “racist” and “power-hungry” are aspects of the syndrome from he suffers and through his outrageous choices while in office, the safety of the nation.
Sarah Palin’s articulate and smart and grounded in what has made America strong. Obama is stolid and stupid and filled with love for himself and disdain for America and awe for Iran, Venezuela, and Communist China.
Sarah Palin’s got it all and the Left and its emptyheaded followers are jealous.... Middle aged women who claimed for the past 50 years to want bright women to get ahead in policicws are it turns out green with envy down to their core. Palin has more than any of them could ever have dreamed of having in the way of moxie, political savvy, solid values - and to top it off - she looks fabulous from head to toe and is not ashamed of that. The Left only sllow merit to be seen in physical and intellectual clones of the ACLU-bred Marxist Minnie Mouse, Ruth Bader Ginsberg.
Hopefully, she’s checking with her lawyer, who will then check with Runners World. It would be great to see both the photog and NEWSWEAK sued.
I think she is keeping quiet because she reckons that these kinds of attacks just make her even more appealing to her base and make the Dems look stupid, sexist and shrill.
And, let’s face it, that is a great pic of a fantastic looking lady!
