The flight surgeon charged with caring for Army Chief of Staff General George W. Casey's pilots and air crew wants President Obama to prove his eligibility now.
The video above provides an overview of his argument.
"I am today compelled to make the distasteful choice to invite my own court martial, in pursuit of the truth about the president's eligibility under the constitution to hold office", said Colonel Lakin.
The news release cited (1) Article II, Sec. 1 of the U. S. Constitution which explicitly provides that only "natural born" citizens can serve as president and commander-in-chief and (2) Mr. Obama's continued refusal to release his original 1961 birth certificate as reasons behind Colonel Lakin reaching the conclusion that his orders are unlawful, and thus MUST be disobeyed.
Today, according to the news release, Colonel Lakin said he had informed his superiors that he cannot understand how his oath of office to "preserve, protect and defend the Constitution" does not permit him, as a military officer, to pursue proof of eligibility from his commander-in-chief. In addition, he noted that his efforts have been rebuffed with legal evasions. Given the Obama Administration's "transparency" initiative, the colonel believes many U.S. citizens are also demanding release of the original birth certificate.
Colonel Lakin's numerous awards and decorations include the Army Flight Surgeon's Badge, Combat Medical Badge, the Bronze Service Medal, the Meritorious Service Medal, the Army Commendation Medal with three Oak Leaf Clusters, the Army Achievement Medal with two Oak Leaf Clusters, the National Defense Service Medal with Bronze Service Star, the Armed Forced Expedition Medal, the Army Reserve Component Achievement Medal, the Army Service Ribbon, the Overseas Service Ribbon and the NATO service medal.
The American Patriot Foundation, a non-profit group incorporated in 2003 to foster appreciation and respect for the U.S. Constitution, has set up a legal defense fund and will provide Colonel Lakin with a top-flight defense team about which details are available on the foundation's SafeguardOurConstitution.com.

He’s a patriot and courageous. The Constitution has the eligibility requirement and it seems to me that a military officer has the best standing of anyone in the country to bring the suit. Can anyone think of anyone who has a better claim to standing? If the courts say he doesn’t have standing then they are saying that no American has the standing to require proof of citizenship of the President.

What I mean is the Army will see to it that his name is dishonored and keep the court martial hush-hush.

I'm aware of that but that doesn't answer my question. Is LCOL Lakin disobeying orders or saying that we really should get around to disobeying orders? Is he disobeying the orders of his superiors or only those that come from Obama directly? Is he advocating disobeying all orders? Some orders? So far he's just talking to the press.

Seriously, there've been several officers who have joined Birther lawsuits and none of them have gone anywhere. Neither will this.
But news of this will spread throughout the officer corps. If an active General follows the same path, Obama is going to sink.

I would suspect he would choose an order that comes from the Pentagon through the Secretary of Defense, but how he goes about this is between the defense team and him. I wouldn't tell you just to give you a tip...and it would be for good reason.

It appears the NBC question of eligibility is going up the chain of command. The next step is General. At some point this will reach critical mass and the proverbial SWHTF!
Yep. So if he refused to obey the order of his superior officer he stands a chance of losing everything he worked for. He will likely be tried and court martialed, convicted and sentenced for disobeying the order of a Colonel or a General, And there is no chance that Obama or his qualifications will ever enter into it.

Different situation here. There seems to be legions in the military who believe Obama is an usurper. It so happens a few of them are willing to take on Obama.

As he states in the video, he is refusing to deploy, believing that doing so would be equal to obeying an unlawful order — until Obama proves he is eligible to serve as CINC.

Oh, I see you have found that old After-Birther talking point.
No doubt the government will try to limit the case to a simple disobeying of the order without qualification while the defense with do its up most to bring the reason why the up in court.
Here is something else for you After-Birthers to chew on. If this LTC is unsuccessful in a military court, he will have STANDING in a civil suit against Obama and the Army for wrongful termination of his Army career.
