The voters can help block the Democrats’ ploy.

Senate Democrats who think they can use a lame-duck session to force the country into a final, decisive lurch to the left may be in for a big surprise: newly elected senators ready to take their seats and derail major policy changes before the new Congress convenes.

There are now six unelected members of the U.S. Senate; they represent Colorado, Delaware, Florida, Illinois, New York, and West Virginia. The rules governing the seating of senators elected to replace appointed senators are left to the states in the 17th amendment. New York’s law specifies the date the new senator takes office as January 3, so Kirsten Gillibrand will still be a senator in a potential lame-duck session, regardless of the outcome of her election bid. The other five states, however, all have laws that indicate the election winners may be seated immediately following their election — in time for the lame-duck session.

Two states are clearly opportunities for the GOP to pick up Senate seats immediately: Delaware and West Virginia. Both are special elections for a portion of unexpired terms — Vice President Joe Biden’s last four years and the late Sen. Robert C. Byrd’s two — in states whose laws specify that newly elected senators are seated once they are certified. Regardless of what happens elsewhere, the winners of these two races should be seated as soon as the election returns are certified.

rotsa ruck getting the rat senate to recognize the new senators... they can drag their feet on that regardless of state laws, and operate with a runt senate or even the old senators (no controlling legal authority, that sort of bs).

Rules and laws only make a difference if the people who enforce them want them to make a difference.

What you’ve mentioned is the utter lawlessness of the US Senate - the same Senate which changed the locks on their doors to make sure that those of us who voted for a Republican could not be represented in the legislative process. Taxation without representation? You bet. But unless the people are willing to fight back against it, it doesn’t matter if it’s illegal.

That’s where America is at right now. If we don’t re-establish the rule of law, anything goes.

Now, wait a minute. Both those states have Democrats for governors. Do they have the capacity to see that the winners are not seated? In the case of West Virginia, I believe the governor is the ‘rat candidate for Senate himself. If he had the power to, I doubt that he’d let his opponent be seated early. Anybody know for sure?

This is OK as far as it goes but it’s the RINOs that will push stuff like cap ‘n tax and amnesty over the goal line for the Dems—and some of the newbies are just as likely to be worthless crud RINOs like Brown turned out to be.

If, miracle of miracles, the GOP manages to edge out the Senate in the 2010 elections, and it’s not close enough to entertain recounts, and, also miracle of miracles, the GOP finds its lost cojones, they can then promise there will be hell to pay if the Donks pull a stunt like that.

And, the clock will have to be turned back to Teddy Roosevelt.

The Donks are playing with 4” stainless steel ball bearings and the GOP’s answer today is Nerf equipment.

Certified,give me a freaking break!Is Obumer CERTIFIED???If so by WHO?There is to much BS in America going on today.Certified is a stupid legal term that states use that means NOTHING anymore thanks to the DF’s in Hawaii.Who certified odumer in the 50 states please come forward.

The Attorney General in Delaware is Beau Biden. Yes, the son of Joe “Stand up Chuck” Biden. Don’t hold your breath expecting him to enforce the law or listen to the people. After all, he would not join the lawsuit against DeathCare, in spite of the people bombarding his office.

As far as he is concerned, we are mere serfs in the Duke’s fiefdom.
