Arizona Rancher forced to pay $73,000 to illegal immigrants for "holding them" for ICE !!!

... remember the San Francisco cabbie who got sued for chasing down a criminal in his cab -- and instead of being called a good Samaritan, lost in court? Well, here it is again. And Arizona rancher got fed up that is land was being invaded by illegals, so he set up surveillance cameras and caught a big group of them, and held them for immigration and turn them over to immigration -- so, of course, this being America, he was sued by the immigrants because he was so mean to them and yes, they won in court and he lost.

Amazing. The Fall the Republic.... the end of America as we know it.

Simple trespass is not a felony...

Nearly any country I can think of, or have been in, illegally entering would be a major felony (Mexico comes to mind) and 10 years in jail.

So illegally entering America is a misdemeanor ????????

I would bet we are the only country in the world where this is true !!!

He needed to "post" his property but like so many folks with huge chunks of acreage just didn't do it ~ still an appeals court will probably let him off the hook and assign costs to the illegals.

Lotsa' luck to the court collecting on that!

From the LA Times POS paper:

Mixed verdict for rancher in migrant case

Roger Barnett of Arizona must pay $73,000 to four immigrants after holding them at gunpoint, a jury finds, but he’s cleared of violating their civil rights.

February 20, 2009|Nicholas Riccardi

DENVER — A federal jury this week found that an Arizona rancher who has complained about illegal immigrants trespassing and trashing his border property has to pay four women $73,000 after he detained them and other migrants at gunpoint.

In a verdict Tuesday afternoon, the jury in Tucson found that Roger Barnett did not violate the women’s civil rights but was liable for four claims of assault and infliction of emotional distress.

We are not talking about entry into the country, but entry onto someone's property. One of the reasons the Latinos love those garden walls is their standard is your yard is not your own unless you assert a right to it WITH A WALL!

Obviously that system changes as they cross the US/Mexican border, but whadda' they know.

The Arizona courts should change their own standards to reflect this reality and begin making examples of Mexican visitors who stray onto private property ~

“on his own land”
That’s the problem. The left doesn’t want you to own land. They hate private property. They want the “oppressed” to just walk in and take whatever they want from you, the evil “oppressor” who worked hard and honestly all his life.
Just more redistribution of income.

Private property - an illusion wherever democrats are in power.

Who gave illegals the right to use US courts to litigate?

Well, I am ashamed, at what the government has done to Arizona — and yes indeed, the country should be ashamed — perhaps it is.

The newspapers are controlled, the magazines are all controlled by the same group of people, the same way the evening news is controlled, I think most of America will never even hear of all this — sad to say.

But I tell you how AZ can get its revenge — Pass a law right now saying that every candidate for president has to produce his original longform birth certificate— and then let’s see what happens.

This explains it ...

Dr. John C. Drew, PhD, met Obama in 1980 and had long discussions with him about a faith they both shared: Marxism.

Drew says that Obama was in complete 100% agreement with his Marxist college professors who wanted a revolution in this country to overturn the power structure. He was consumed with the notion of wealth redistribution & more affirmative action programs to bring about less inequality and more income equality.

He had kind things to say about the Soviet Union (like Alice Palmer his mentor) S.U. was a better model than the USA !!!

He and Chandoo drove around together in a BMW. They looked like a wealthy gay couple. Looked like “multi-millionaires”. Chandoo went to the Ramadan dinner at the WH last year but “doesn’t remember meeting Obama” until a photo of them shaking hands was produced.

* Frank Marshall Davis
* Flag-stomping Bill Ayers
* Alice Palmer (Barry was chief of staff to this Chicago Communist)

“My most vivid memory was in how insistent he was in arguing a Marxist-Leninist point of view.”

He insisted a real revolution was coming ... and then Marxist-Leninists would be on top !!!”

“He definitely saw America as the enemy”.

“The ruling elite had rigged our economic system to cause people to be poor, had unfairly taken all the money and that America needed ‘Redistribution of Wealth” to make matters fair”.

Dr. Drew was the founder of the Anti-Apartheid Union and the student Marxist Students Association in 1976 at Occidental College, (but has later changed his (Drew’s) views.)

Dr. Drew explains in one minute on YouTube: http://www.youtube.com/watch?v=mBGBszZ2Qw0&feature=related

Who the hell was on that jury???? The Plaintiffs? The over whelming ignorance of people in this country is disgusting. Where in the hell does this make sense?

Ah, so this was a federal civil rights decision. Probably making a claim of racism due to violation of Arizona citizens arrest statutes.

So the fedgov won't do it's job, but will allow the federal court system to be used against someone trying to deal with the ramifications of such.

Even if it is posted, there are varying levels of trespass.

Typically it is a misdemeanor to be on posted property. It rises to a felony if you stay there after being told to leave (defiant trespass), or if there is another crime involved, such as breaking into an outbuilding.

The problem here is detaining someone after simple trespass - he can confront them and ask them to leave, and if they oblige and start walking for the property border, that means the trespass remains at the misdemeanor level.

This is why the Minutemen were smart to just observe, not detain.

How can the illegals sue him? Is it our justice department suing him? If they are illegals how do they have right to sue him? Sounds irrational to me. We used to have to leave our hunting lease cabin doors unlocked and leave out water and bread for wetbacks or else they would break into and tear everything apart. We learned that after awhile they would not tear stuff up if we just left them food and water. One time I was hunting and a group of six wetbacks walked out in front of my blind about 200 yards away. It freaked me out a little I won’t lie. In this case though the rancher should be awarded $73,000 for all the damages in property that were averted.
