It would appear from the response that her initial service on the Attorney General was in contravention of the Rules. Per the response, the position of the folks in HI is that the service should be in person, not via any other manner, or to anyone other than the person intended.

Thus Taitz, not being a prosecutor, has no tangible interest.

The method of service is not important at this point since Fuddy chose to respond. It was just thrown in as part of the "throw in the kitchen sink" response. As was their determination that the birth certificate had no relationship to the Social Security Card. Doesn't someone need a birth certificate to get a Social Security Card? The throw in the kitchen sink response is one of the most common defenses. Whether or not it will work depends on the political leanings of the judge.

The entire document was supposedly already released to the public so it is difficult to understand why anyone would have any objections to showing the original to document experts at this point. But we have seen this plenty of times before. Hawaii will fight this to the Supreme Court if neccessary just as a stalling tactic regardless of what common sense might tell you.

Here is a prediction: The judge will agree with Hawaii and deny Taitz’s request.
