Perry Ruling: Perry Denied (only Mitt & Paul on ballot)

A Judge has ruled that the ballot will stand as is for the Virginia primary with Ron Paul and Mitt Romney as the only candidates in the presidential primary.

In a 22 page ruling the Judge basically said that the Plaintiff’s: Perry,Gingrich,Santorum,Huntsman waited too long to file their request for an injunction.

The Judge said: “In essense, they played the game, lost, and then complained that the rules were unfair,” Judge Gibney pulled no punches here: “They knew the rules in Virginia many months ago; the limitations on circulators affected them as soon as they began to circulate petitions. The plaintiffs could have challenged the Virginia law at that time. Instead, they waited until after the time to gather petitions had ended and they had lost the political battle to be on the ballot; then on the eve of the printing of absentee ballots, they decided to challenge Virginia’s laws….The traditional purpose of a preliminary injunction is to prohibit an action. Preliminary injunctions are meant to protect the status quo…In this case, the plaintiffs request that the Court require the Board to add their names to the primary ballot, which is a positive act that alters the status quo.”

In essence the judged looked at the LAW, and ruled on the LAW, and didn’t practice activism. Fantastic. If people do not like the ruling they need to change the LAW in Virginia!

Yes, it will be interesting to see how Romney does against a single candidate, even Ron Paul.

The whole system is a joke. We get no say in the nomination process anyway as its always over long before our primary in NC.

Some have said that the State of Virginia made the rules, Not the Republican Party of Virginia.

Either way, the fix was in.

Very very bad things happening.

A Mitt forced on the Republican Party over the very strong Conservative wing, opens Pandora’s Box.

This may go on right up to the Convention.

Yep, and here in TX we are tied up in the court drawn reapportionment mess. We are waiting for them to re-open the filing process because of the delay.

What a mess.

You cannot blame anyone except the candidates. Perry's campaign has been well-funded and Newt lives in Virginia. This is the second state (Missouri) in which Gingrich failed to qualify.

The so-called "circulators" getting the qualifying petitions for candidates to be on the ballot apparently have to be from Virginia, and not from out-of-state (I read this elsewhere), but the point is...

How could a theoretically main-stream candidate mess this up?! SHEESH!! So the Virginia primary will basically be a waste of time, although not convention delegates, in actually choosing a nominee to run against Obama, and that's very unfortunate, IMHO! What's the point of a Romney/Paul contest??

More clarification on this issue would definitely be welcome!!

It doesn’t speak well of the Gingrich, Santorum, and Perry campaigns that they allowed this to happen. And it looked even worse that they turned to the courts to fix their poor planning and execution.

Actually this is just more of the Republican establishment protecting themselves. Yes they did wait too long to cry BS (why because they are part of the establishment).

This law is intended solely to keep non establishment candidates off the ballots.

And if someone sued with enough lead time the judge would rule that they weren’t harmed yet so they have no case.

This whole thing stinks. While my candidate’s ox doesn’t get gored by it, it still stinks to high heaven. Remember that the decision by the VA GOP to review the petitions was made very soon before the time ended to submit the petitions.

I was going to vote for Ron Paul anyway, but this just makes me all that more determined to help him win in VA.

Oh, and I’ve decided to join the VA GOP as well. For the very first time I finally have some good reasons for wanting to be a Republican. Lord help me, it’ll tough to bite back the bile.

I’m a Ron Paul supporter, so I will. But there is no way to put a write-in on the ballot.

The whole thing stinks like week old fish.

Something is still stinking in VA over this.

I thought the Judge told Perry it would be better if the others enjoined with him, well they did. Now the Judge says they ran out of time???

This is the type of Judge Newt says needs to be replaced ir fired.

Yep, I am planning to be at the Texas Republican Convention.

The scheduling of this mess is in limbo because of the court redrawing the reapportionment districts.

We check daily to be informed when they will open the primary candidate process again. They froze it when the court acted.

The Primary date is set in April 3rd, but as of 1-5-2012 “the courts have set the final day a person can file to be on the Republican (or Democrat) Primary Ballot as 6 PM on February 1st, but as of this moment, the day you can begin to file for a spot on the ballot is STILL TO BE DETERMINED BY COURT ORDER.” (still no date as of 1-14-2010)

What a mess.
