The recent SCOTUS decision on Obamacare is stark evidence that the judicial branch has pushed the envelope toward a national crisis. While I’m not yet convinced that we’re witnessing the proverbial straw that breaks Uncle Sam’s back, we could very well be watching a preview of coming attractions.

I'm not giving Obama any vote. I reject the reasoning that "a vote for anyone other than Romney is a vote for Obama" for if this were true then my vote literally does not count unless I vote a particular way. That is more an indictment of the system than it is of me.

Ah, so you're just going to go quietly into the night? I honestly hope that I am shedding enemy blood before that point, because if it gets to that point then I, and every person sworn to uphold/defend the US Constitution, have failed utterly.

I refuse to use a relative scale. Roberts is a "better justice" than who Gore would have appointed... yet what quality is he?

so as far as you're concerned, every decision by a judge that you basically believe in must be in accordance with your own opinion.....good luck on that one.

I would be very dubious of a judge who agreed with me on every matter, that would lower him to my level of legal understanding....and believe me, that could be very dangerous.

Now, put your list of Republican presidential nominees in juxtaposition with Democrat nominees, and tell me which ones are worse. You cannot take one or two boneheaded decisions and throw the whole baby out with the bath water. We’re it not for Roberts, you would have already lost most of your 2nd Amemndment rights. Was his Obamacare decision troubling? You bet your sweet arse it was. But make no mistake about it. A vote not cast for the sub mediocre Romney IS a vote for 4 more years of the current White House stench. You will be digging your own grave. Hold your nose like the rest of us and pull the R lever, and pray to the Almighty God in Heaven that we are afforded a little more time to fend off the wolves.

No, I did not say that. The problem is precisely this: any judge who thinks that a) it's been done before makes it ok, b) the constitution is whatever the USSC says it is, and/or c) the USSC can alter the Constitution ought not be a supreme court Justice.

a -- is precisely the idolization of case law and precedent.
b -- is a proud mind, incapable of accepting the authority of the Constitution over his position.
c -- is one who thinks himself above the law, a Black-Robed God-King.

I could list 1,000 and you would not care. Solipsism on the Right can be as bad as solipsism on the Left. And those kinds of arguments, especially here at FR, are endless and fruitless. . . as well as old news. An election is at hand. One reaches a point where one chooses to put a little faith in people (all of who are imperfect creatures), or one does not. I choose to. When good men do nothing, evil fills the vacuum, which is what your negativity would allow. I am saddened by that, but I hope you have a good day.

My negativity? I'm truly sorry you see my refusal to support the GOP's selection of such a lackluster candidate as 'negativity.'
The GOP isn't my wife, I said no vow to stick by it is sickness and in health, in good times and in bad; why should I give it that level of commitment?

Maybe the article should have been titled “Flashpoint: Free Republic!”

The simple fact of the matter is that in 2012 a president will be elected no matter how much you complain about the result. The choices are simple too. You can vote and contribute to the victory/defeat of either candidate or you you can contribute to neither.

Do whatever you think will create the greatest good but don’t say the results are all equal.

I will vote for Romney as I think he’s a decent man. Obama is certainly not.

You’re assuming they won’t be the same judges.
Besides, the quality of a “good judge” is objectively not relative.
