GOP legally barred from fighting vote fraud

The case is the Democratic National Committee vs. the Republican National Committee, originally from 1982.

Democrats alleged Republicans were trying intimidate minority voters in New Jersey and brought the legal action. The RNC, inexplicably, decided to agree to a consent decree before a Democrat-appointed judge rather than fight the claims.

The judge, Dickinson Debevoise, appointed by Jimmy Carter, later retired but decided he would continue to control the case. The decision requires the RNC – but not the DNC – to “refrain from undertaking any ballot security activities in polling places or election districts where the racial or ethnic composition of such districts is a factor in the decision to conduct, or the actual conduct of, such activities there and where a purpose or significant effect of such activities is to deter qualified voters from voting; and the conduct of such activities disproportionately in or directed toward districts that have a substantial proportion of racial or ethnic populations shall be considered relevant evidence of the existence of such a factor and purpose.”

The rest of the agreement essentially requires the RNC to follow applicable state and federal election laws.

But the section cited above has been used for decades to warn off Republicans from any challenge to evidence of voter fraud in districts with “racial or ethnic populations.” The law has remained, even though the RNC recently challenged it at the appellate level only to be turned down by Judges Joseph Greenaway Jr., appointed by Bill Clinton; Dolores Sloviter, appointed by Carter; and Walter Stapleton, appointed by Ronald Reagan, in the 3rd U.S. Circuit Court of Appeals.

It now is pending before the U.S. Supreme Court.

But two election veterans both told WND it still is hurting the fight against voter fraud in the United States.

And that’s why the Republican Party is also known as the Stupid Party. To trust Democrats not to cheat their way into office is ludicrous after their long history of vote fraud.

The decision is online, through findlaw IIRC. I’ve got to head to work, please post link to the ruling for verification.

The Freeper Boot Licking Brigade will be by soon to derride you for deviating from the loser’s narrative. Best to have verification up front.

The GOPe has been make up of girlymen for thirty years it seems.

Calling for all real conservatives to once and for all flip the finger to the Republican Party and move - together - to the Constitution Party. For the good of the country and to retain your own credibility.

Thanks for finding this. I had a lawyer friend asking about this the other day. Bad deal for the RNC. Given the left’s propensity for fraud, it amounts to a suicide pact. Bad lawyering.

The cure is simple, but requires a lot of work on our part. The same ballot security activities have to be observed in every district of every town. Treating everyone the same is an affimative defense against the bogus charges of discrimination. Every QUALIFIED voter gets to vote...ONCE!

Time to dump the GOP party. Let's just call the opposition to liberalism the TeaParty. United against taxation/mandates without representation. Make NO agreements with any of the liberals.

It’s just one of many, many reasons.

And yep, it is time to dump the GOP.I do not care if doing so results in democrat majorities for the next 100 years, It’s no different if the gOP exists or does not exist, it’s time.

As part of a lawsuit settlement with the Democrat Party, the Gutless Old Party agreed to not engage in any voter protection initiatives. Two of the clauses read this way:

(e) refrain from undertaking any ballot security activities in polling places or election districts where the racial or ethnic composition of such districts is a factor in the decision to conduct, or the actual conduct of, such activities there and where a purpose or significant effect of such activities is to deter qualified voters from voting; and the conduct of such activities disproportionately in or directed toward districts that have a substantial proportion of racial or ethnic populations shall be considered relevant evidence of the existence of such a factor and purpose;

Having read about this in various forums and posts, the remaining question I have is why every political group on the right has not raised this situation throughout all these intervening years. Obviously, there is a way to get out from under this ,beyond stupid, one sided deal with democrats. Could have been done years ago. Form a new party doing the same as the closed down GOP. And why is this coming out now at this particular time?
Seems to me we still do not know all of the facts especially how fraudulent voting cannot be stopped under the civil rights voting laws. I am missing something but thirty years is a long time for Republican administrations to have tolerated this facilitation of voter fraud.

So... I guess having armed Black Panther squads at polling places is not voter intimidation but voter ID is.

Sure looks like it. But communism is sure alive and running thing. I'm afraid we have lost our Country and might never get it back without a civil war. The communists are using our very laws to destroy America.

It was a Republican who freed the slaves. It was the Republican party who first pushed for the women's vote and civil rights.

It was the democrats who started the KKK and and perfected black voter intimidation.
