WASHINGTON D.C. - Though resident of the District of Columbia are denied the right to voting Representation in Congress and to control their local affairs – rights all other United States citizens enjoy – the residents of the District of Columbia have been exclusively granted by Congress a right no non-District of Columbia resident possesses: The right to a post-election challenge to the qualifications for office of any elected official. That statutorily-granted legal “standing” to challenge qualifications is found at D.C. Code §11-1001.11(b)(1).
Accordingly, Montgomery Blair Sibley has this day filed a Petition for Review in the District of Columbia Court of Appeals seeking to challenge the qualifications of Barack Hussein Obama, II to occupy the Office of President of the United States. Additionally, Mr. Sibley has filed an Omnibus Motion in that matter seeking subpoenas for Mr. Obama’s: (i) original birth certificates, (ii) Selective Service and Social Security records, (iii) college applications and transcripts from Occidental College, Columbia University and Harvard Law School and (iv) his passport records – all documents Obama has refused to reveal

Sad is that we have had a lot of the GOPe Media support Obama on this issue and attack “Birthers”. Wonder how many Conservatives stayed home because people like Hannity, Levin, Coulter, Malkin, O’Reilly, and others kept attacking any Conservative who brought up Obama Eligibility? I bet a lot more stayed home on election day over not going after Obama Eligibility....than Hispanics not voting GOP because there was no Illegal Alien Amnesty....

I’m not a lawyer, but I notice that this suit was filed in the DC Court of Appeals, a ‘state’ court (DC is not a state but its courts are considered ‘state courts’). IIRC, Quo Warranto has to be filed in the U.S. District Court(a federal court).
As I understand it, there is some quirk in the law because of DC’s unique standing that an appeal to SCOTUS can be taken directly from the DC Court of Appeals (vs. the appeal to SCOTUS typically coming thru a federal court). Perhaps a FReeper lawyer can explain the technicalities/procedures/differences between the court systems and how a DC appeal can go directly to SCOTUS ???

You are right! Quo Warranto would have to be filed in the US District Court in DC, a federal court. The DC Court of Appeals “is the equivalent of a state supreme court” according to its website, so an appeal would go directly to SCOTUS from there:
