Arizona Electors Question Barack Obama Birth Certificate

The chairman of the Arizona Republican Party and two other Arizona members of the Electoral College on Monday questioned President Barack Obama's birth certificate during the formal casting of the state's electoral votes.

Arizona GOP Chairman Tom Morrissey said during the state's Electoral College meeting that Obama did not produce a "legitimate" birth certificate, KNAU reports.

Arizona Gov. Jan Brewer (R), who has vetoed bills to require presidential candidates to show a birth certificate to Arizona's secretary of state, said she disagreed with the trio's stance. Secretary of State Ken Bennett (R), the presiding officer of the Arizona Electoral College, also said he disagreed with what the three said.

hm, I think the courts would be foolish to go with their standard “you don’t have standing” approach because these are the electors: they have personal involvement and the ethical obligation to ensure their votes are for a valid candidate.

Hmmm...since AZ went for Romney and AZ is winner-take-all, they all voted for Romney. But I would think they might have standing to have their preferred candidate not be defeated by an ineligible candidate. (IANAL)

Too bad Arpaio and Zullo didn't have a legal opening to at least make a presentation (or were denied one). The fix is in as far as the GOPe is concerned on the NBC issue. Heck, they still want to keep the door open for Rubio, Jindal and Haley as well.

we need to vote to remove any politicians who continue to cover this up

the issue merits review through the proper channels

and the American public deserve it be done per our Constitution

I'm not sure that the legal standing doctrine is even a Constitutional doctrine. When you look at the wording of Article III, it says judicial power applies to cases in Law and Equity arising under the Constitution as well as "controversies" between a number of different legal entities.
... to Controversies to which the United States shall be a Party;--to Controversies between two or more States;-- between a State and Citizens of another State,--between Citizens of different States,--between Citizens of the same State claiming Lands under Grants of different States, and between a State, or the Citizens thereof, and foreign States, Citizens or Subjects.

Under the last clause, one can make a compelling argument that any citizen of the United States could bring a case against Obama as a foreign citizen or subject because he's lacks article II eligibility for the office of president. Further, one could cite Fairchild v. Hughes which suggested that legal standing only applies in challenges against the Constitutionality of statutes (which is not at question here), and that:

Plaintiff has only the right, possessed by every citizen, to require that the government be administered according to law

The seating of a president certainly falls within this scope as there is a vested right for every citizen that the president should be Constitutionally eligible for office, and that ensuring this is executed properly is a matter of ensuring that the government is administered according to the Constitution.

The Huffpost article is poorly written - doesn’t explain what this means. Is this a legal objection, and what is the procedure as a result of this objection? Does this go to court? What happens?

I think Carl Gallups may have oversold the ability of these “constitutionally authorized” AZ electors to accomplish anything other than grouse from the sidelines, which is why I called it “snark.”

Their job today, as I understand it, was to rubber-stamp the AZ electoral vote for Romney. They did that. They have no votes to withhold from Obama.

At least they spoke up, and generated a buzz that even made it to HuffPo. With most of the cable showing pictures of the CT “baby angels” (RIP) 24/7 I’m not sure how many folks will notice.
