What’s been the biggest challenge in challenging Obama’s eligibility in court? It’s been finding a judge who isn’t afraid to allow the merits of the case against Obama to be argued in court. The Alabama Supreme Court might just be different.

In an earlier case before the Alabama Supremes, Associate Judge, Tom Parker, stated “McInnish has attached certain documentation (Joe Arpaio’s investigation) to his mandamus petition, which, if presented to the appropriate forum as part of a proper evidentiary presentation, would raise serious questions about the authenticity of both the ‘short form’ and ‘long form’ birth certificates of President Barack Hussein Obama that have been made public.”

Here we have a judge who actually recognizes that the fake birth certificates are...

Has Larry Klayman ever won any significant case? He’s been fighting the good fight against government over-reach since the Clinton years, but I can’t recall any significant wins by him or his group.

Here’s my dream scenario: Supreme Court of Alabama rules he is ineligible to serve, thus nullifying any law he has signed in Alabama. Other states follow suit and this ends up fast-tracked in the SCOTUS where he is ruled ineligible and every law and appointment he has signed/made is vacated.

Won’t happen, but it’s nice to think about.

I’m kind of a grump on this issue.

Where does the Constitution say that courts sit in judgment on the eligibility of the President. The electors vote. The Secretaries of State certify the state vote. This issue was raised by HRC’s minions before the election so the electors had a chance to consider it.

I think the issue is Constitutionally assigned to the electors, not the Courts. If you consider how the Court would frame an order in this case, it becomes even more apparent. “BHO is hereby enjoined from entering the White House or exercising executive powers?” And what happens when he just keeps on issuing executive orders? Are the federal marshals going to arrest him? Not a chance.

The second remedy would be, of course, impeachment.

Courts have appropriated far more power than assigned by the Constitution. This is a political issue not resolvable by Courts in any appropriate manner.

I hate to tell people but as long as one parent was a US citizen, he could have been born in Zimbabwe but he’s still considered a US citizen.

This is why Ted Cruz is eligible to be President as well.

Whoa! I never saw that before. Birthplace Kenya on the bottom? #23? Do they mean him or his father? What does that say, evidence for delayed filing? Meaning why are they filing late after his birth? So the reason given is he was born in Kenya as per his Grandmother? Wow if you could find out where you got this that would be great. I can’t believe it is legit though because this is the first time I am seeing it.

I think its too late to go down that road. Barry is probably not eligible but nobody is going to remove him from office for it.

The Supreme Court of Alabama can't declare that Obama is ineligible to serve, because Obama isn't even a party to the lawsuit in Alabama. It's a lawsuit by one voter against the (Republican) Secretary of State of Alabama, arguing that she (the SoS) should have investigated Obama more before putting him on the Alabama ballot in 2012. The lower court held that the SoS is not required to conduct an investigation.

If the Supreme Court of Alabama reverses, that doesn't mean that Obama is ineligible, it means only that the SoS should have investigated him. And so what? That might set a precedent that, in future elections, the SoS must investigate candidates before putting them on the ballot, but it's too late for her to investigate Obama now, because it's no longer possible to take Obama off the 2012 ballot, and he didn't get any electoral votes in Alabama anyway.

It’s another fake, proven by the fact that the law it cites, HRS 338-17.8 wasn’t enacted until 1982.

That is a typical foreign born registration. A person is born foreign but a parent can still receive a certificate of live birth, which is not the same as a birth certificate which says a person was born on US soil. This way a birth can be recorded that the parent is the parent of the child. Often used when a foreign birth certificate is lost or unavailable.

Section (C) was adopted in 1982 but the entire law is not annotated as to adoption date.

The problem with that theory is that the Governor and the Hawaii Department of Health Director who originally verified Obama’s birth records back in 2008 were Republicans: Governor Linda Lingle and Health Director Chiyome Fukino, MD.

“You know, during the campaign of 2008, I was actually in the mainland campaigning for Sen. McCain. This issue kept coming up so much in the campaign, and again I think it’s one of those issues that is simply a distraction from the more critical issues that are facing the country. And so I had my health director, who is a physician by background, go personally view the birth certificate in the birth records of the Department of Health, and we issued a news release at that time saying that the president was, in fact, born at Kapi’olani Hospital in Honolulu, Hawaii. And that’s just a fact. And yet people continue to call up and e-mail and want to make it an issue. A Hawaiian "Republican" is likely as conservative as a Massachusetts "Republican."

I don't put much stock in party labels any more, but in real conservatism.
