This all started over the govt taking land in 1993 that the Bundy family has had access to since the late 1870's in which their cattle graze. The land has been deemed a protected habitat for the desert turtle where Bundy's cattle can still graze as long as they pay the grazing tax. The family has refused to pay the tax which has ballooned according to the feds to $1.3 million, keep in mind to run this operation of armed govt agent stormtroopers and removing the cattle the cost will be over $3 million! Yea that's the govt for you proving they cannot run anything!

Anyone see a problem with this right off the bat? If the grazing zone is deemed a habitat for a turtle how does paying a tax all of a sudden make it safe for the desert turtle? Grazing cattle theoretically are "destroying" said habitat are they not? But the govt sees a rancher paying a grazing tax as a remedy but makes no effort to restore the "damaged" areas! Typical govt hypocrisy!

This is an incredibly dangerous slope we are on.

Take note one of the protestors screaming at the BLM rangers is making it clear who the aggressors are and it isn't the unarmed people! Throwing a woman to the ground, repeated tasering of unarmed protestors who are no threat to armed stormtroopers with attack dogs is asking for trouble! With the current high level of disapproval for govt  coupled with the prevalence of the internet, social media, 24/7 new coverages this standoff is going to escalate extremely fast. What you are witnessing are the early stages of what is referred to as the Bubba Effect...

Yea remember when Beck warned about it and everyone mocked him over it! Well it's coming to fruition now! Regardless of the true issue at hand whether one has broken the law or not people are so fed up they will come to another's aid to defend them. When this footage goes viral, and more like is to come, you can be sure the call to arms out already by citizen patriots is going to increase where the numbers will double if not triple. If a shot is fired by the feds be prepared for a conflict, the people of this nation are completely fed up with govt violations in every aspect of our lives and will not allow another Waco or Ruby Ridge.

The only advice I can give those rushing to support the Cliven Bundy and his family is be careful and have the law on your side. Do not keep the govt stormtroopers the edge, you have to be one step ahead of them. Keep cool use your heads, the protestors  in this video won this battle running the rangers out without any violence on their part! This looks like a setup....for some bad press....its stupid.

Defame an entire demographic with coverage of this shyster.

Yes, I would like to know why the standard state laws for grazing wouldn’t apply, i.e. obligation of a land owner to have a “legal fence”.

We had neighboring property to one of our pastors that was owned by a local man renowned for being the worst type of cattleman. He owned 40 acre plots all over the county, moved his cattle around from one to the other all the time, and never kept up his fences.

His cattle would get out onto our property and he would never respond when called to come get his cattle in and fix his fence.

One summer he decided to plant corn on the other side of the fence from our cattle pastor. Guess what, once those ears started filling in our cattle moved in mass through his 2 wire rusty fence and began feasting on that corn. Dad called him and left a message, “Harry, you need to come out fix your fence, my cattle are moving through it.” Not realizing which fence it was, Harry did his norm and just ignored the call. Within a couple of weeks, the corn was gone.

Later on we had an issue with about a dozen of his cattle that had gotten out and we woke up with them in our garden. When called he said, “I’ll be out in a few days to take care of it.” We ran the cattle down the road about 4 miles and told him the same when he came out (2 weeks later).

His family has paid for those access Rights for generations.Yes, and no.

From 1934 to 1993, the Bundy family held a grazing agreement and paid grazing fees for part of the old Bunkerville Allotment. That's where the Bundy family was grazing his cattle in 1993.

Now, Bundy is grazing his cattle in the old Bunkerville Allotment, the BLM's Gold Butte area, and National Park System land within the Overton Arm and Gold Butte areas of the Lake Mead National Recreation Area. The Bundy family never paid for access to the Gold Butte or Overton Arm areas.

Was it because of a turtle and the Endangered Species Act?

Bundy didn't move the grazing area. He expanded it.

He is still grazing cattle on the original old Bunkerville grazing allotment.

Since he quit paying grazing fees, he expanded to graze in additional BLM property in the Gold Butte area.

He also expanded into National Park System property within the Lake Mead National Recreation Area.

As far as I’m concerned, I don’t care if this man is grazing his cattle for free.
As far as I’m concerned, any exercise of federal force on individuals is WRONG. Their only jurisdiction is dealing with external threats and with unresolvable conflicts between state governments.


It seems to me that there are now two issues here.

1. Grazing rights.
2. Rights of peacefully protesting American citizens.

I can answer that now.

The federal court found that federal law requiring a permit to graze conflicted with Nevada open-range law. The court ruled that, under the Supremacy Clause of the Constitution, federal law prevailed over state law. (Note, however, that Nevada state law also requires a permit and payment of a fee to graze on federal land.)

The 2013 Bundy court order relied on U.S. v. Gardner, 107 F.3d 1314 (9th Cir. 1998) in making the Supremacy Clause ruling. I haven't Sherpardized Gardner.

You should read Gardner. It contains all of the arguments being made by Cliven Bundy and the federal government except Bundy's claims that he is being evicted under the endangered species law rather than a claim of trespass.

Frankly, I don't care. It's being billed by the overreaching feds as "public land" to be used by "everyone." Well, last I checked, Bundy is part of everyone.

Never mind the fact that he is a productive rancher who contributes to the local and national economy.

Now, add to that the fact that his family, who have been grazing that land since the 19th century, also improved the land at their own expense. I'd say the feds can bugger off.

Of course, this whole thing has nothing at all to do with a big solar power deal the feds worked on the down-low that looks to provide a lot of cash to the feds, er, power to the region. Using "public" land with "endangered" reptiles.
