Constitutional Crisis and the Immediacy of Article V

The contrast evident yesterday between the brilliant speech of Benjamin Netanyahu and the deplorable behavior of the house republicans was a wake-up call, indeed a slap in the face, to all patriotic Americans. Witnessing a true lover of freedom speak for the world, indeed for us, was a shock that was soon juxtaposed with our betrayal by the uniparty, again. The contrast was almost too much to take. The multitude of emotions and the steely realization that something needs to be done now to save our republic was the prevailing mood in my area. What are our options? Since it’s blatantly obvious the November election had no effect on Washington D.C., it’s up to We the People.

The abuse afforded the American people by Obama and his ilk has cause incalculable damage to the psych and culture of our American spirit, not to mention the civilized world. The domestic violence afforded us has taken many forms. Please allow a short rant:

The abuse from the MSM by not vetting Obama in the first place, the lies about his background and history, Obama’s obvious dislike of our country, his Manchurian Candidate elections, ACORN, voter fraud, Alinsky, Gruber, (yeah, we're too stupid), 'community (agitating) organizing', Obama’s Marxist upbringing, OMG his background has been so hidden by him and his press, the damn in the pocket MSM . . first thing he did on first day of office was seal Every Record of his. . so much data. . Nachum's list. . IRS scandals, Lerner, Benghazi scandal, Hillary, Kerry, VA scandal, illegals treated like royalty, executive Amnesty, NO Border Fence, inviting illegals not to mention ignoring our immigration laws, exponentially expanding welfare, net neutrality takeover, 13% real unemployment, constant race card, Holder, Van Jones, Jarrett, czars, . . by the way, what the hell have the czars done? . . Obamacare scam and now we have socialized medicine, Obamaphones, commie SCOTUS judges, fake Birth Certificate, 18 Trillion Federal Debt disgrace and slavery of our progeny, Frank Marshall Davis, Ayres, Dohrn, Wright, Pfleger, corruption, cronyism, dislike of our military, anti-Semitism, hatred for Israel and Judaism, Rashid Khalidi, the hidden LA Times Tape, Cairo speech and ongoing apology tour, more taxes, more regulations, out of control EPA, ignoring our laws, changing laws by executive fiat, Bergdahl swap, 'workplace violence', never saying Islamic Terrorism, lame lame foreign policy, pathetic State Department, the DHS list of 72 "types" of Americans considered domestic terrorists, . .

OMG get me going and I'm just getting started, . . the proposed .223 ammo ban, constant back door gun control schemes, Fast and Furious, more illegal executive orders . . 'pen and a phone'. .feet on the Oval Office desk, ‘Arab Spring’ mess, promoting a nuclear Iran, negotiating with terrorists multiple times, ignoring Bibi’s speech, the in your face vacations, constant use of the Alinsky playbook, the arrogance, NPD, 'the attitude', his obvious racism, Holder and Just Us, pals with Sharpton, Muslim Brotherhood friends, not defending Christians and Jews, not defending all of us, 'spread the wealth around' stuff right out of the Communist Manifesto, the Islamic finger, no hand on heart during National Anthem, the Semper Latte, ignoring Bibi, sabotaging Bibi's election, the pathetic petulant response to Bibi's speech, the Iran nuclear sellout, setting our country up for attack by gutting our military, Muslim prayer before the Terror summit, vetoing the keystone pipeline, appointing commies throughout the bureaucracy, anti-capitalist, anti-small business. . . It will take several generations to clean this mess up. The time to start is now.

You see Obama, We the People are shocked and bloodied, but there’s still plenty of fight in us, and fight we shall, for we are fighting for freedom, the greatest force on earth! We are mad as hell and want redress.

We the People, just as our Founders did in their list of grievances against King George III, now declare (Thanks to Mark Levin) our current list of further injuries and usurpations against Obama:

1. “You have violated the Separation of Powers.”

2.”You have seized unto yourself Legislative Power granted unto the Congress alone.”

3. “You have unilaterally appropriated monies to fund your radical agenda.”

4. “You have contravened Congress’ authority over Immigration and Naturalization.”

5. “You repeatedly defy the Senate’s confirmation power over your appointments.”

6. “You have poisoned the independence of the Judiciary by appointing scores of radical activists to lifetime judicial appointments.”

7. “You have repeatedly evaded the Senate’s role in the adoption of treaties.”

8. “You’ve shown nothing but contempt for the Bill of Rights.”

9. “You’ve shown nothing but contempt for private property rights and free market Capitalism.”

10. “You have nationalized to destroy the greatest Healthcare System on the face of the Earth.”

11. “You have recklessly destroyed the fiscal well-being of this nation with wild spending schemes, driving up the Federal operating debt to $18.5 Trillion and unfunded liabilities to over $100 Trillion.”

12. “You have directed Federal Departments, like the EPA, to unleash thousands of regulations. . . “

13. “You have driven the median-income of Americans down. . . “

14. “You have used the Office of the President to balkanize the American People along lines of race, gender, age and income. . . “

15. “You have showed contempt for our military. . . “

16. “You have failed to take necessary steps to confront Islamic Nazism. . .”

17. “You have undermined our friend Israel to the detriment of our security.”

"The hour is late, very late, and The Republic is slipping away."

We the People have no choice except to take it by the numbers, but like Bibi, we shall not stand idly by if we do not have redress, and soon.

It behooves us to call emergency meetings in the state legislatures to pass an Article V application. Citizens request their state legislators to pass a bill called an application. They pass an application and then, Congress shall, by law, call a convention when it receives application from 2/3s of the states. (34 states) Delegates are chosen in each state legislature and attend the convention. Each state gets one vote but each state may send as many delegates to the convention that they choose. Amendments are proposed, debated and voted upon at the convention. Ratification then takes place in the states. Each amendment must be ratified by 3/4s of the states (38 states) for it to become part of the Constitution.

The steps back to our Constitutional Republic, as stated previously by Grace G, are:

1. Elect More Republicans – This step has failed, given our mandate last November and total failure of the RINO/socialist Uni-party confluence and dereliction of constitutional duty.

2. Article V Convention of States to propose Amendments – Immediate action needed to try and take power from the federal government back to the states and reel in the federal leviathan.

3. State Nullification - Last ditch effort to try to take power back from the federal monster, though by this point it may be too late...

4. State Secession - Could either end up peaceably like the breakup of the Czechoslovakia in 1993 or a brutal:

5. Civil War II like the first one....

We now know # 1 is a complete failure.

The longer we wait on #2, the more likely #3, then #4 and finally #5. .

Quick review: We need 34 states to pass an application, then Congress shall, by law, call a Convention of States as soon as it receives applications from 2/3 of the State Legislatures. That's 34 states. We now have 30 working on it. Amendments are proposed and voted on at the convention. Each Amendment must be ratified by ¾ of the states in order to become part of the US Constitution. That’s 38 states.

For those worried about a con-con, “There are far more political and legal constraints on a runaway convention than on a runaway Congress.” - Robert Natelson

Remember, an Article V convention is only for proposing amendments to the constitution - that then have to be ratified by 38 states. For those that still worry, do you have any other viable options, short of revolution? As I see it, we have a patriotic duty to pursue the Article V process before we venture down the roads of nullification, secession and civil war.

We the People have a responsibility to make Article V the most understood aspect of the US Constitution.

Here is an example of an amendment that the states can propose under Article V:

AMENDMENT XXVIII

To redress the balance of powers between the federal government and the States and to restore effective suffrage of State Legislatures to Congress, the following amendment is proposed:

Section 1.
A Senator in Congress shall be subject to recall by their respective state legislature or by voter referendum in their respective state.

Section 2.
Term limits for Senators in Congress shall be set by vote in their respective state legislatures but in no case shall be set less than twelve years or more than eighteen years.

Section 3.
Upon a majority vote in three-fifths of state legislatures, federal statutes and federal court decisions shall be overridden.

If Section 1 above can be replaced with a repeal of the 17th, then that’s even better but it may be a hard sale. Section 1 above gets the job done by making US Senators pay attention to their State Legislators and at the same time requiring both to interact with the state voters.

At this point, do you really think Congress will abide by the law and allow a constitutional convention? My suspicion is that regardless of whether we get 2/3 of the states to move for one, a con-con will never happen because congress, the courts, and the emperor will simply refuse to acknowledge it. They may, in fact, spin the states' votes into 'articles of secession' as a predication for dissolving the constitutional republic and replacing it with a true centralized tyrannical government.

Don't forget that a majority of American voters were stupid enough to elect- and REELECT this POS president. They can be led by the nose to believe pretty much anything the government wants them to believe.

I have completely given up on any notion that the existing government is even remotely interested in doing the right thing- even when the majority of states provide a constitutional mandate for it.

What congress did yesterday was tantamount to a declaration of war against all American citizens in every state.

Now the question is: regardless of what the states may choose to do, what are we AMERICANS going to do?

Thanks for the info and the Levin ALEC link, a great speech. Term limits and repealing the 17th are certainly needed, especially term limits.

My personal opinion on your question is that no one in the federal government will abide by any amendments that would come from such a convention.

Laws are for the law abiding, and that does not describe this government at all.

However, I still think this final civil step is worth trying. It is the right thing to do to say that we tried all tools at are disposal to fix this before we had no choice but to...

And the time to do this convention is right now, today. there simply is no more time. Our government is completely insane and utterly corrupt.

I have the same fears you have. I still think we have to forge ahead with Article V. If they ignore the petition from 34 states to form a Convention of States, then it truly is a declaration of war and it will be time to form up. .

Although I have ideas for new amendments to the Constitution, I hope that patriots understand the following. A major part of today’s constitutional problems is that all three branches of the corrupt federal government are blatantly ignoring the federal government’s constitutionally limited powers.

In other words, yes to Article V, but also yes to impeachment and accusations of treason.

I suppose I'm a radical in this regard, for I think the states do not need permission from congress to meet in convention.

Still, you are correct in assuming DC will likely deny enough applications exist to call a convention, for more than enough exist now.

Thank you both for this. Lot of good info/links here. Time to get to work at the local level.

To those who say ART V will never work:
- it is worth the effort,
- it will tend to clarify the question of which politicians are real patriots,
- and it may indeed be a necessary step along the road to a more dramatic resolution.

Let's take care of this while our armed forces are yet manned in the largest part by patriots.

You're welcome. As you said, time to get to work at the local level. I'm working on Idaho reps. The one's I've talked to are very interested in the idea, but no formal application approved yet.
