I want to point out something that needs to be considered in light of the bump stock ban. Given the wording of the regulation, many reasonably asked if binary triggers would be affected. Leaving aside the fact that the ban is based on a lie as brazen as claiming the sky is green, it turns out the new regulation does not ban binary triggers.
From page 83 of the ruling:
"The Department disagrees that other firearms or devices, such as rifles, shotguns, and binary triggers, will be reclassified as machineguns under this rule. Although rifles and shotguns are defined using the term "single pull of the trigger," 18 U.S.C. 921(a)(5), (7), the statutory definition of "machinegun" also requires that the firearm "shoots automatically more than one shot, without manual reloading," by a single function of the trigger, 26 U.S.C. 5845(b). While semiautomatic firearms may shoot one round when the trigger is pulled, the shooter must release the trigger before another round is fired. Even if this release results in a second shot being fired, it is as the result of a separate function of the trigger. This is also the reason that binary triggers cannot be classified as "machineguns" under the rule--one function of the trigger results in the firing of only one round. By contrast, a bump-stock-type device utilizes the recoil energy of the firearm itself to create an automatic firing sequence with a single pull of the trigger. The Department notes that ATF has already described a "single pull of the trigger" as a "single function of the trigger." See ATF Ruling 2006-2."
The logic of this is pretty circular and convoluted to say the least (though it at least doesn't resort to outright lies and falsehoods like the bump stock ban does).
There is something here we need to consider. The BATFE was under no obligation to include this in their regulation. They could've just as easily said nothing about it and enforced it against binary triggers after the fact. Certainly, the wording of the regulation banning bump stocks certainly seems like it would apply to binary triggers.
However, the BATFE specifically went out of its way to explicitly state they were not banned.
Basically, the BATFE is more on our side than Donald Trump is. Process that for a minute, and appreciate how thoroughly we have been betrayed.
From what I can tell, it should be. IANAL.
Concur.
We cannot let this stand.
I was hopeful that we could actually get some gun laws repealed when Trump was elected and the republicans had all the pillars of government. There were bills sitting in the house like the hearing protection act that would have taken suppressors off the controlled list. But no, the republicans are not any better than the democrats. Americans are not served by either side.
This is a big deal.
Next “Obama” will use ATF to regulate and ban any evil-looking “assault weapon” “black” guns, magazines over 10 rounds, pistol grips, jacketed bullets, etc.
This was a huge mistake and the camel is now fully inside the tent - Trump you just F*d up big time! Democrats are drooling over the possibilities when they get their next president and it’s game over for liberty -
Democrats will use ATF to ban 0.50 cal. by fiat - just because they can.
Somebody needs to pay for something...but those who abandon Trump over bump stock are idiots and one of the reasons we have a Congress full of RINOs - they make a lot of noise and then do the most damage to the cause as possible.....and most of them want everything their way, they want it now, and they want someone else to do the heavy lifting for them....like the illegals who demand a cut of our taxes, the biggest whiners invest nothing of themselves while exhorting others to do it all.
I have a hexadecimal trigger.
If I wanted gun control implemented by unconstitutional fiat Id have voted for cankles.
The 2A is the unwanted bastard child of the bill of rights. I cant even count on my supposed allies to support it.
Gun rights continue to shrink instead of expand because of allies like you. Eventually people who care about the 2A might start caring about your religious liberty, your 5A rights, and due process rights as much as you care about their 2A rights. That would be a sad day.
Yall had better find a cure for your recto-cranial inversion with a quickness. Otherwise we are going to have no liberties.
You dont get to pick and choose which God given natural rights you want to fight for and which ones you dont. Fight for them all. Or lose them all.
So you are OK with the president amending federal law without congress passing a bill? Do you prefer to be ruled by a king? Because thats what you are asking for.
It amazes me on a website called Free Republic how many times liberty and freedom has to be pointed out, explained or defended.
People are stupid. Everyone thinks this is about bump stocks. Thats a minor issue. This is about deciding if you want to live in a monarchy or a republic. Most Americans seem ok with monarchy in this instance.
It is becoming clear that the people are not worthy of able to keep a republic. The American public is approaching the point that it deserves whatever misfortune befalls it. Its a shame theyre dragging the rest of us along for the ride.
This one is the kicker for me.
I don't personally like bump-stocks; however demanding property of something the legislature doesn't like? That is wrong. I cannot believe this is not headed for SCOTUS already.
smh
They’re public knowledge. I’m not telling anyone anything they didn’t already know about.
I assume you mean private party to private party?
Over the counter sales. Only instate residents can buy a handgun after the 1968 law was passed.
A resident of a different state cannot take possession of a purchased handgun if out of state. They can still purchase it, it just needs to be sent to an FFL in their home state and fill out form 4473 and complete the background in their home state.
Yeah - and we should allow Fentanyl over the counter and in bagged up powder form too....right?
So, in other words, you hate freedom. It may not infringe upon the man made 2nd amendment, but it infringes on peoples rights period. A right is that which does not harm another being. I, we, you harm no one by owning one therefor it doesnt matter if its a toy or not, its our right to own one if we so choose.
Its going to be a cold day in hell before you get his blind supporters to realize theyve been duped. I admit I supported him, but I also know when Ive been duped and it didnt take very long to figure that one out.
