U.S. District Court Judge Hands Desperate Alvin Bragg a Massive Loss in His Effort to Avoid House Investigation

As we reported on Tuesday, Manhattan District Attorney Alvin Bragg was desperately trying to stave off the House investigation into the question of the political nature of his prosecution of former President Donald Trump.

Bragg filed a suit against the Chairman of the House Judiciary Committee, Rep. Jim Jordan (R-OH), arguing the investigation was a “transparent campaign to intimidate and attack” his case against former President Donald Trump. He sought to get a temporary restraining order blocking the subpoena that the Committee issued to Mark Pomerantz, a former assistant district attorney in Bragg’s office who oversaw the investigation into Trump before he left the DA’s office. Bragg also tried to block the Committee from getting “confidential documents and testimony from the district attorney himself as well as his current and former employees and officials.”

Bragg is trying to do all he can not to comply, claiming he was taking action “in response to an unprecedently [sic] brazen and unconstitutional attack by members of Congress on an ongoing New York State criminal prosecution and investigation of former President Donald J. Trump.”

But the judge in the matter did not agree. U.S. District Court Judge Mary Kay Vyskocil, a Trump appointee, denied the request from Alvin Bragg for a temporary restraining order against Rep. Jordan. In the denial, the judge noted that Bragg didn’t even provide documents he should have to support his cause, including that “subpoena purportedly served on Mr. Pomerantz” as well as the “Declaration of Theodore J. Boutrous, Jr.,” which is mentioned in Bragg’s moving papers. Sounds like Bragg didn’t help himself, and the judge is chiding him for failure to have everything he should have had for such a motion.

The judge gave Jordan until April 17 to respond response to Bragg’s suit and then the court will consider the matter on April 19.

Mike Davis, founder and president of the pro-Trump Article III Project and former Chief Counsel for Nominations to Senate Judiciary Chairman Chuck Grassley (R-IA) told Breitbart News that Bragg’s lawsuit against Jordan is “laughably frivolous.” “Soros-funded Manhattan DA Alvin Bragg’s lawsuit against House Judiciary Chairman Jim Jordan is laughably frivolous, as evidenced by the fact Bragg couldn’t even win a temporary restraining order,” Davis said. “Harvard Law should demand that Bragg return his law degree.”

Jim Jordan also called out Bragg’s effort.

First, they indict a president for no crime.

Then, they sue to block congressional oversight when we ask questions about the federal funds they say they used to do it.

But it looks like Bragg just got his head handed to him on this one. We’ll have to wait to see the final hearing on the matter, but it’s fair to say that things are not going well with his effort to duck the investigation from Jordan and the Committee.

When you go down the banana republic road of targeting your political opponents, you shouldn’t expect that you can get away with it in our free society that should still operate according to the rule of law. Fortunately, it looks like the Republicans are going to hold Bragg’s feet to the fire and hold him accountable. He’s trying to wriggle out of it, but so far, it’s not working.

I wouldn’t get my hopes up too much on this - the Dems are EXPERTS at stonewalling Congress, and the GOP are EXPERTS at being stonewalled.

And THAT is why the Letticia James indictment had to be announced. They needed a safety. If both get indicted, then it’s off to Georgia.

Jordan can raise hell but that’s about it. Bragg will likely just ignore him, knowing the rules are different for democrats.

Overlapping and mutually reinforcing demands in multiple forums can present tricky problems in litigation.

In this case, the House committee is likely to have a much stronger hand in getting damaging facts against the prosecution than Trump has as a disfavored defendant in state court in New York because the House has oversight authority and represents a branch of the federal government. Armed with facts exposed by the House committee, Trump may then be able to override delay, resistance, and bad rulings by the New York trial court that aim at having Trump convicted no matter the eventual result on appeal.

Contrary to what is commonly said, justice is not blind in such cases because most judges tend to be political creatures. They especially do not want to be criticized or embarrassed or made fools of.

The grand jury’s indictment in Georgia is severly tainted by the interviews its foreperson gave to multiple MSM outlets. She is, in effect, and abject, biased moron.

I’m always curious about the lack of audits by anyone in the local or state governments. I understand that Bragg has spent somewhere in the neighborhood of $200M on a $130G crime. What sane person would do or allow that? Our local commission would bbq a prosecutor for such nonsense.

She is going after the whole Trump organization claiming criminal business practices and corruption. Something like that. What gets me, there are 4 legal actions against Trump right now. Bragg in New York, Leticia James in NY, the Georgia investigation for election tampering and the Carol woman that claims Trump “raped” her in a dressing room of a department store sometime back in the 90’s. Can you see a man of Trumps discerning tastes personally shopping in a department store and going to the dressing room section just to molest some woman whom he claims he didn’t know at the time? First off, Trump shops by the businesses coming to him, not the other way around.

1. We’re not even sure if it’s a crime

2. Even if it were legally a violation what was the SEVERITY? Were any investors harmed? Did anyone lose money? Who exactly was the victim other than Trump’s family?

3. I’m not sure about this $200 million figure. Seems over the top. The Mueller Russia Hoax special counsel investigation only cost about $40 million tops. But even then, you’re right, why spend tens of millions over a mere potential $130,000 violation?
